Why would anybody want to go to every country in the world?  Why would anybody like me, who believes crossing some arbitrary line on a map of the world and ticking a list is meaningless, want to go to every country in the world?

Well… I want to do it so that I can burn my passports to protest the injustice of borders, the idiocy of visa practices, the absurdity of defining people by their statehood, the total illogicality of making people spend billions (let alone put their life at risk) to cross the borders you’ve set up while you yourself spend billions on police, building walls and fences to block those people and then complaining that you need to look after these people whom you let into your fictional line because of your international obligations. In short, to make a tangible, a noticeable complaint about the absurd workings of this world.

What are borders? They are imaginary lines drawn by either a literally bloody war or by metaphorically bloody politics called diplomacy. Defining people by the imaginary line they are born in, defining their radius of movement on the earth they were born, again by that imaginary line is nothing but madness.

How Did I Get Here?

I did three circumnavigations of the world. The important detail here is: I did the first two of these trips on a Turkish passport. My first round-the-world tour was in 2001. I quit my PhD studies at Mechanical Engineering and decided to travel the world. When you wish to travel, the first thing you do is make a research on visas: Which countries require them and what they ask for to give you a visa.

Tanzania was on my route. I heard that until recently, we (the Turkish) did not need a visa to go there. However, there was a bombing in some embassy and allegedly a Turkish was involved in the case. So now we needed to get a visa. I didn’t think anything about this news. I found out the contacts of the Honorary Consulate, went there, paid my dues, and got my visa.

It was only after a second round-the-world tour in 2008 and many beatings with dealings for visas that I came to question the premises of that Tanzania visa requirement:

So… One guy did something bad and millions need to pay a price. Let’s suspect all the people who happened to be born within the same imaginary boundary as that man. “From the baby in the cradle to the 80 year-old ladies, all people born within the same imaginary line as that bad guy are suspects from now on!” goes the firman. Yeah, right. Sounds pretty rational to me!

Grouping people according to the imaginary line they were born in and treating them as one is the most ridiculous thing ever.  Yet, it is done so thoughtlessly and so matter of factly by “big big” people who are our “leaders” and respected by almost all of us “small” people.

Citizens of the so-called “Western” countries do not need visas to visit most of the UN countries. There are 193 “recognized” countries, and EU and American passport holders are exempt from visas to go to about 160-173 of them. The rest, the ones they need a visa for, they are mostly not interested to visit anyway. As for the citizens of the “not so Western” or developing countries, they do not usually get to travel much. Even when they do, they usually travel with tour groups or for short periods of time, they just pay the agencies the fees and go along with their life. Sure, there are backpackers too. Even so, they travel in places where they’re not asked for a visa or go get their visas like I did. Only when you travel on a not-so-prestigious passport and without any plans and you bump into so many imaginary lines that you become aware of those lines. Someone sitting on a booth at the airport, asking you why you are going somewhere… where your stamp is… Someone being paid for this…

Someone being paid to sit at a desk and process papers from you to judge if you are “fit” to go into the imaginary line they were born in. It is also so illogical, the papers they ask from you to “grant” you a visa, like a hotel reservation which can be cancelled anytime, that it makes you want to pull your hair out.

Then there is the arbitrariness of it. I was returned from the border of Panama because I had completely forgotten that I needed a visa for it while skipping happily in Central America. Two weeks after my “expulsion,” the visa requirement was lifted. On two grounds: One, the Turkish no longer needed a visa because of some diplomatic relations. Two, there passed an Executive Decree saying those who held US visas valid for three months which had been used at least once could enter Panama with a simple Tourist Card. Regardless of their nationality… So had I been there just a month later, I would have gone in without any trouble.

Ah, sometimes it works the other way around too, in happy ways. I was ready to pay my due to get a visa for Brazil. I went to the embassy and found out that I no longer needed one. Why? Because the son of a Brazilian politician had recently married a Turkish girl. Good for them. Thank you. (And please don’t get divorced. I’d like to visit Brazil again. Without hassle if possible…) But is it logical, is it just, is it fair? That things should work this way?

Persona Non Grata

At the end of the second world tour which was to be by sea, I was faced with another ordeal. I carried a special passport which did not require a visa for EU countries. So I came to Italy without any hassle. However, on the way back to Turkey, I was going to go through Greece, which demanded a visa even from the special passport holders. But there are no borders between Italy and Greece.: Which means there are no check-points. I went to the Greek Embassy in Rome just to make sure. They told me that I needed a visa, I couldn’t get it from Rome. “Go to Turkey to get a visa,” they said.

What??! Go fly to Turkey and back in order to go to Turkey by sea? Didn’t make any sense to me. I had had a similar experience passing from Sweden to Norway which was not in the EU. No problem at all. I also had not been let into Switzerland from the Geneva airport, but once I got in France, I walked into Switzerland freely, smiling at the immigration officer. So I said I’ll go through Greece too. And I did.

However…

On the way out, that is going back to Turkey from Greece, I was stopped and told I was to pay a fine of 600 Euros and they’d be putting a “Persona Non Grata” stamp on my passport. Person Not Wanted… I was so indignant, I told the immigration officer to go ahead with it. I had not done anything wrong, I had not sneaked in to “their” precious country, I was just going back to “my” country. Returning with a “persona non grata” on my passport from a second circumnavigation of the world would be my badge of honor!
My Italian boyfriend, who was to become my husband, did not look kindly or approve of my retort to “officials”. He was thinking about the practical problems we would be faced with, basically the fact that I wouldn’t be able to enter the EU to be with him were I to be labeled “persona non grata.” Anyway… A sweet and reasonable supervisor intervened and I went back to Turkey only to get married (in Las Vegas, which again was by force of law, but that’s another long story) and settled in Italy.

Needless to say, the third round-the-world tour I did with my family was uneventful as far as visas went, because I now possessed two passports. An EU one along with the Muslim one which covered the countries that did not “like” the Westerners so much. I used whichever was convenient. I was the same person, but now that I had found myself a husband who was born in a prestigious place in the world from a prestigious womb, my status had changed.

It took me about 90-100 countries (to travel to) to see the injustice of visas and borders. I felt it in my skin. The humiliation of being made to go around for papers as if I was a rat in a maze, being returned from a “border”… Just because of the passport I carried. My wanderings were for me to realize how the world is partitioned off to political parcels, how we are not born as a human being but as a “citizen”, how we belong to governments and therefore subject to their whims and mandates/dictates.

To me, it’s about an injustice. The one main unarguable, undeniable reason for removing the need for visas and letting people roam the world they were born on freely is the injustice and unfairness of it. Discriminating people according to the imaginary line they were born in is Global Apartheid. It is Birthplace Racism. It is Injustice at Birth.

I care so very much, because I have such an unshakeable belief that this global apartheid is so very utterly unacceptably unjust, and therefore, even if impractical needs to end.

Looking For Logic…

It’s also the illogicality of it. You happen to be born in some place to some parents and it shapes all your life and the extent of your movement on the Earth you were born. I don’t believe in equality. We are not born equal on this Earth. We all have our physical and psychological challenges to face. However, simply striving to get a basic decent life overcoming the obstacle of your geographical birthplace, your “statehood” should not be among those challenges.

There is also the economical illogicality. According to the migration researcher, professor Hein de Haas, we spend 1 billion euros a year to keep “them” out, the refugees and/or economic migrants spend another billion euros to get in. Now tell me how does this make sense??! It’s all such a huge WASTE of resources. We force migrants to use up all their money on human smugglers, wasting time and exhausting themselves trying to cross borders just to get somewhere. If we, that is governments removed the visa requirements, these people could just get on a plane for a couple of hundred bucks and have money in their pockets to pay for their expenses, have the energy to contribute to society etc.

Think of all the money that could be saved on “our” side too, all the money saved from all the controls and blocks trying to keep people out… That could be used for a much more useful purpose. I have no doubt the world would be in a much better and much secure place for all of us if that money was spent on people and their basic needs. The warlords’ making profit out of arms sales need to stop.  There is no real security in this world but just the “feeling” of it. I understand even the feeling of security is important; however, the price we are paying is unacceptably too high!

What’s more, if visas were lifted, they would move back if they didn’t feel good in one place. Now, because the price they pay to settle in one place is so high, they cannot give it up.

I quote from the article “Humanity Adrift: Why Refugees Deserve Better” in New Internationalist:

“Until early 1990, Moroccans did not need visas to enter Spain. They would come for seasonal work and then leave. As soon as visas were introduced, immigration from Morocco rocketed. And instead of returning, people stayed put. ‘If we had visa-free migration, more people are likely to come to work, and to have a look around – but also to go home again,’ says Hein de Haas. It’s only when you obstruct this flow that you get a crisis.”

Logic is a forgotten word in the dictionary. People, conditioned by rules and regulations, do not know the meaning of it anymore.

Why Do People’s Mental Border Stop Too Short?

I’m fine with borders. Borders are necessary, we need them as human beings. What I’m not fine with, however, is being born into a border and being defined by it all your life. If people form groups by choice, then they’re welcome to set up borders for themselves. (For example, gated communities. I wouldn’t want to live in one, but they’re fine by me.) But how do we set borders? Some people in power set up borders, then we, are born into a border.

We no longer live in tribes. Being born into a border, in a village, could have been acceptable at those times. No longer… It is so self-righteous to claim a certain piece of land belongs to you and “your” people because you were born within some border. I claim the world to be mine.: Just because I was born on it. And I believe every single person on this Earth has a right to that claim.

An angry Bulgarian was asking “Why I should respect such people when they violently enter my country and my continent?” I understand people claiming a country to be theirs, as that’s how we’ve been raised to believe. This man was claiming a whole continent to be his too. I said “Good for you. But why do you stop at the continent? Why don’t you say the whole world belongs to you as you were born on it? Which is basically what I am saying. The world belongs to us all. Wherever we, you, they may have been born!”

The world we grow up in shapes our views. We are like kittens which were brought up in an only vertical line world and cannot recognize horizontal lines when they grow up. We’ve been looking at the world through the lens of political borders all our lives, it’s time to remove that lens to see things clearly.

Even though the contemporary political world order has turned it into this… The Earth is not a place to be parceled into countries and forbidden to people who themselves, their parents or spouses have not been born there or let in on conditions. It is a land as a whole, to be lived and traveled on for some time and then buried under.

Eppur Si Muoveranno

To be honest, I don’t know what I hope to accomplish by travelling to every country and then burning my passports. Perhaps I don’t even care to accomplish anything. I just know I have to do it. I feel the push to protest. Maybe it’s just to relieve the humiliations I have faced travelling the world. Of course it’s not personal, I hope to do this on behalf of all the people who have died in vain, all the wasted sad lives which are treated as just numbers. And perhaps maybe, just maybe, it could evoke a response, “raise awareness” as people say. Someone who has travelled the whole wide world burning her passports could make more people become aware of this injustice.

How nice it would be if more people would join me and we burnt all our passports together. But that’s getting too way ahead of myself…
I said I don’t care to accomplish anything; on the other hand, I have an ambition to change the world. I would like to have borders removed as barriers of movement, I would like visas to be abolished, I would like to end statehood and citizenship the way they are defined today. However, I do not set out to accomplish these. I only do what I have to do and let life and history take its course.

I wish to note that I do not believe in sacrificing one’s self. I mean I would sacrifice myself if I knew it would serve something, make a positive change in the world. So when I do burn my passports, I plan to burn the old ones as valid passports are official documents and burning them is a criminal offense. My husband thinks that wouldn’t be a real protest. “If someone whose life is travelling gives up that right, it would be meaningful only then,” he says.

However, change happens slowly, change happens when the time comes. I am on the side of Galileo who said that the Earth did not revolve around the Sun. I would have done the same. What would have happened if Galileo did not recant? Would the Catholic Church have said, “Ah see? Such a prominent scientist did not recant even with our threats; therefore, the Earth must be revolving around the Sun”? No. Galileo’s life would have been more of a hell unnecessarily, that’s it. What happened that Galileo recanted, did the truth change? No. Why would you put yourself through needless torture when your cries would only go through the deaf ears of ignorant rulers? For no reason… We got there. Nobody really believes in geocentrism anymore. Even though almost about four centuries later, the Church apologized.

Last year, when I started writing vigorously on being free to roam the earth we are born on, I felt there was not much hope. Now I see many people talking about open borders and I know we will be getting there too. It is so obvious that this is an injustice that cannot continue. Of course it cannot be done in spite of the people opposing the idea, a general consensus needs to be reached. Still, the fact remains… Opening up borders, acknowledging everyone’s right to move around and live anywhere they wish on the planet they are born is the moral imperative of our time.

Galileo allegedly said “Eppur si muove” after recanting. And yet it moves… I say “Eppur si muovono.” And yet people move… You may make laws, require people to carry passports and get visas, build walls and fences, put surveillance cameras, the police… Eppur si muoveranno. Yet people will be moving… True, some may die along the way. Yes, some may even give up. But you will never be able stop the movement of people. Because movement is not a right, it is a fact, it is a life force.

And so it will be as long the Earth keeps circling the Sun.

Two Senses of “Open Borders”

A few months ago, someone pointed me to François Gemenne who last year gave several interviews to German-language newspapers on migration. As the Swiss “Tagesanzeiger” phrased his claim (my translation from the German):

“The migration researcher François Gemenne states that whether borders are open or closed has no effect on the extent of refugee flows. But on the number of those who die“.

While I agreed with a lot of the arguments that Gemenne made, I was baffled by this assertion. It was not the first time I had come across such a claim. As far as I can tell, also the Dutch migration researcher Hein de Haas holds a similar view although I am not sure  (cf. his inaugural lecture and especially his second assertion).

My intuition is wildly different. I would expect very many immigrants if borders were actually open, even so many that a gradual transition might be warranted. And it could not be a narrow definition of “refugee” that makes the difference. As far as I understand Gemenne and de Haas, they are referring to migrants (including refugees in a narrow sense). That got me thinking whether I missed something.

Still I did not change my mind. According to Gallup polls, there are literally hundreds of millions worldwide who would like to migrate to a developed country. Maybe it is easier to express your desire in a poll than realizing it if it were possible. But to get from hundreds of millions to practically no one, you would have to assume that almost all respondents entertain totally unrealistic plans. And even if the polls were unreliable, there would still be strong economic incentives to migrate. Earnings differentials are huge, so it makes a lot of sense for very many people to migrate. What explains the vastly differing views?

It took my some time to realize that maybe both claims can be right, and that is so because we are simply talking about two different things when we use the shorthand “open borders.” On the one hand, “open borders” can mean that you scrap border controls or reduce them to a minimum. Whether de facto or de jure, there is hardly any impediment to crossing the border. I think that is the first intuition most people have. It also ties in with a vision of tearing down walls and fences.

On the other hand, “open borders” can mean that foreigners have the same or at least very similar rights as domestic citizens: they are allowed to settle and work in the country and they also have associated rights, e.g. to open a bank account, register a car, travel back and forth, etc. Maybe “open borders” is not the correct term here, and “freedom of movement” comes closer or “free labor mobility.”

The two senses of “open borders” are independent. In principle you could have “open borders” in one sense without having “open borders” in the other. On the one hand, you can imagine a country with a very high wall at the border that does not allow anyone in without some official procedure. But at the same time, the country could grant foreigners the right to settle and work. Having such border controls would seem superfluous, but they might be in place for security reasons or because of some other rationale. And on the other hand, there could be a country that does not control who enters the country, but treats all foreigners who settle and work in the country as in breach of the law and persecutes them accordingly.

I think this distinction can explain the different views. If foreigners are allowed to settle and work in the country, there is in principle no limit to how many could come. There might be some temporary constraints, e.g. how many new jobs can be created over the short term, or how many apartments can be built. But over time, there is no apparent upper bound. If there is a very high level of demand for immigration, as indicated by international polls or as a consequence of high earnings differentials, there should be a lot of immigration. The main point here is that immigrants are allowed to immigrate legally and have a secure and permanent status.

Now in the other case, things are very different. Everyone could enter the country because there is no real impediment to crossing the border. However, they would not have a legal status. And that means lots of things. E.g. they can be sent back if they are apprehended, maybe fined and imprisoned. Or their belongings might be confiscated. Another consequence is that they lack the security of legal immigrants and cannot make dependable plans over the long term. They would also find it hard to bring in their families because they are in a continually precarious situation.

The differences do not stop there. So far the problem for illegal immigrants is that they are in the crosshairs of the government. But enforcement can also be directed against domestic citizens, e.g. landlords and employers who deal with illegal immigrants. Throw in many other handicaps: you cannot get insurance, you cannot register a car, you cannot get an official degree or a license, you cannot buy a ticket from an airline and travel back and forth, etc., and it adds up to a very difficult situation for an illegal immigrant—no matter whether border controls are strict or non-existent. Enforcement will never be perfect, so there should still be a niche for illegal immigrants.

Why a niche? Suppose there were a lot of illegal immigrants in the country. Maybe it is hard to find a few percent in the population (e.g. for the US it is about 3%, for Germany it might be less than 2% or even 1%). It could also be hard to track down their landlords and employers. However, the more illegal immigrants there are, the easier it is to find them. If every second person were an illegal immigrant, even Inspector Clouseau could find one.

The basic relationship should be something like this: If S is the share of illegal immigrants in the population, then it takes a certain number of checks to find one, and this number should be proportional to 1 / S, a hyperbolic function that goes to infinity as you approach 0.

Share Checks

It would be extremely costly to find the last illegal immigrant in the country. But costs come down considerably as the share of illegal immigrants rises. At some point, you would not even have to search for illegal immigrants in the first place because you stumble over them as you do other things, e.g. when the government tries to collect taxes. So the real constraint might come from enforcement within the country, not from enforcement at the border, and it might be enforcement against domestic citizens and not so much against the illegal immigrants themselves.

My conjecture would be that the main constraint is the size of the illegal labor market. You cannot hire illegal immigrants in any line of business. E.g. if they are very visible for the public, it won’t work. Or in a large company with specialized functions (separate HR department, different divisions), a lot of people would be involved, and that would make it difficult to hide illegal employees from the government. Or in a business that creates paper trails for everything and where money flows are rather transparent, employing illegal immigrants should also be a major challenge.

So, typical businesses that employ illegal immigrants have to be rather small and/or intransparent (e.g. restaurants, construction, agriculture). Or employers are not even businesses, but private households (e.g. for nannies, gardeners). That alone severely limits the size of the labor market for illegal immigrants relative to the total economy. And it also pushes illegal immigrants into jobs with relatively low productivity because the relevant businesses cannot participate as openly and widely in exchange, or else risk making themselves vulnerable. A constraint on their size also means a constraint on the sophistication of their production processes.

One indication that there is some rather stringent bound on the share of illegal immigrants in the population is that estimates are in the lower single digits for all developed countries. There are different estimates, but none of them ever go beyond a few percent. Obviously, the level of border enforcement is quite different. If that were the main reason for keeping the share of illegal immigrants low, I would expect not only more variation, but also some countries with very high shares of illegal immigrants.

A further indication is that the same holds for US states, though with more dispersion. Nevada was the state with the most illegal immigrants, 10% in 1990 and 7.3% in 2010. But most states were in the lower single digits, with some that had almost no illegal immigrants. Still, most US states had a share of illegal immigrants above 1% or 2% and many even above 3%. Now if the main constraint were border enforcement and not internal enforcement, I’d expect illegal immigrants to settle right across the border. What’s the use of branching out to other states? It only means more costs, being farther away from home, and having to find your way when you could stay where others have already blazed a trail.

However, if internal enforcement were more imporant, such behavior would make perfect sense. The more illegal immigrants there are, the easier many things get, but also the more conspicuous you are and the more likely detection becomes. One guess would be that less diverse parts of the country are also less congenial to illegal immigrants than more diverse parts of the country where you can slip through more easily. Actually, there is a rather strong connection between diversity in a state and the share of illegal immigrants (although admittedly there could be other explanations). Here is what I got when I ran diversity in different states (probability that two random people have the same ethnicity) against the share of immigrants:

There are two ways internal enforcement can work against illegal immigrants: Living in the country per se could be the problem (e.g. renting accomodation, controls by the police, etc.) or finding a job to stay afloat. In both cases, illegal immigrants have to rely on illegal markets which are part of the shadow economy. And that introduces a constraint on the share of illegal immigrants because for developed countries with a certain level of enforcement, there is an upper bound on how large the shadow economy can be relative to the official economy. By its very nature, estimates for the size of the shadow economy are not easy to come by. According to one approach by Friedrich Schneider, estimates for 2013  were in a range from 6.6% for the US to some 15% for countries in Northern Europe and 20% in Southern Europe.

However, these estimates have been challenged by Thiessen and Kholidilin for what I think are good reasons. One observation was that a shadow economy of some 15% of GDP would mean the government is missing out on a lot of taxes it could collect. As Ulrich Thiessen explained in an interview, that was exactly what the German government thought: 70 billion euros. So in 2004 a task force, 6,000 to 7,000 strong, was created to fight illegal employment (not primarily by illegal immigrants). The whole affair turned out rather disappointing for the German government, though. While the task force cost about 600 million euros, it raked in a measly 30 to 40 million euros of the supposedly 70 billion floating around, and the Federal Court of Auditors (Bundesrechnungshof) politely demanded an explanation from the government what they were doing.

The results by Thiessen and Kholidilin would indicate a much smaller shadow economy of 1.1% for the US, less than 3% for Northern Europe, and mostly less than 5% for Southern Europe. No matter what the correct estimate is, there has to be a bound on the shadow economy if there is some level of enforcement. And the labor market for illegal immigrants has to be at most as large as the shadow economy, and hence it has to stay rather limited.

But why would the labor market be the bottleneck? It could also be controls by the police going from door to door. My explanation would be that incentives for the government to go after illegal employment and, by implication, also illegal immigrants are very strong. As the example above shows, governments get very active when they sense an opportunity to collect extra taxes. And it makes more sense to go after those who could pay fines and have the money: employers.

By comparison, going after illegal immigrants has rather little political potential. Yes, the public always wants a crackdown in the naïve belief that illegal immigration could be lowered to zero. But in reality, even if the government were somewhat successful in this regard and could shrink the stock of illegal immigrants, it would be hard to even prove it happened with such obscure estimates. Figures for the stock of illegal immigrants in Germany range from 100,000 to well over 1 million (cf. Worbs/Wolf/Schimany: Illegalität von Migranten in Deutschland, page 7).

Of course, this is no proof that the main bottleneck for illegal immigrants has to be the labor market. But let me refer you to three papers that would more or less support my conclusion:

  • Camacho/Mariani/Pensieroso: Illegal Immigration and the Shadow Economy. – The authors propose a model that connects illegal immigration and the shadow economy. They then derive general relationships. Border enforcement appears less effective than internal enforcement on the labor market. And if the two compete (cf. extended model in the appendix), more border enforcement can paradoxically lead to more illegal immigration because the shadow economy expands.
  • Boswell/Straubhaar: The Illegal Employment of Foreign Workers: an Overview. – The conclusion of this article is:  “Efforts to limit the supply of irregular labour through entry controls or internal checks, meanwhile, are socially and economically costly. The best strategy would be to develop better ways of tackling the problem at the demand side: increasing the costs and probability of apprehension for employers, and lowering the costs of hiring regular workers.”
  • Leerkes/Engbersen/van der Leun: Crime among irregular immigrants and the influence of internal border control. – The authors show for the Netherlands how internal enforcement is effective in driving illegal immigrants out of the labor market (and as an unintended consequence into outright criminal activities). There is also evidence that the Dutch police—quite reasonably in my view—do not put a lot of effort into chasing illegal immigrants, but focus on fighting crime, no matter what status the criminals have.

If all this is correct, the situation for illegal immigrants on the labor market could look like this stylized graph (my apologies to everybody who draws the diagram with quantity horizontally, but in this way I can make my point more easily):

There are very many potential immigrants who are interested in a job (red), but the number of jobs available (blue) is capped by a rather hard constraint. Such a situation might explain the observations de Haas and Gemenne have in mind. If the number of jobs available goes down with the general state of the economy, there should be corresponding movements in the stock and then in the flow of illegal immigrants. And the response is rather strong.

Enforcement at the border leads to a fixed sum an illegal immigrant has to pay upfront. Typical estimates would suggest a few thousand dollars. This alone shows that border enforcement is effective to some extent. Actual travel expenses for legal travel are usually much lower (e.g. less than 100 euros for crossing the Mediterranean). The relationship between the size of the flow and the cost of detection should also be hyperbolic: If millions tried to cross the border it would be very easy to clamp down on the flow. But only to a point. It gets harder and harder, the fewer people you try to detect (I looked at an extreme effort in my post: “How to Seal a Border” for the border regime of the GDR).

Still, this does not have to mean that border enforcement is the main bottleneck for illegal immigrants. With an average stay of two or four years, border enforcement works in the sense that it inflicts a cost on immigrants and throttles large flows. But it is more like a “tax” of 100 or 200 dollars per month. Illegal immigrants might also face credit constraints, so it could be hard to get the initial sum together. However, there are ways around this, at least to a certain extent, e.g. support by previous immigrants, families, loans that have to be paid back afterwards, etc.

Now, if enforcement at the border is stepped up, the fixed sum goes up and hence also the “tax.” This means the red  curve shifts to the right. But if the number of jobs (blue line) is more or less capped, the stock of illegal immigrants will not change a lot. Likewise, with less enforcement at the border: The change could be small. I am not sure I understand the argument why there would not be any change, but it might be that the effect of increased border enforcement stays rather limited. Apart from that, border enforcement is directed at the flow. If illegal immigrants stay longer to make up for higher up-front costs, even with lower turnover, the stock of illegal immigrants could stay steady.

If this reasoning is correct, then there are two conclusions:

You can only make the argument on the effect of border enforcement if you assume that enforcement within the country stays the same and immigrants do not obtain legal status. If you are willing to bite this bullet, I might agree, but I am not impressed. Surely, it would be an improvement if illegal immigrants could enter the country in safer ways. However, what if the real wall is the one around the labor market? And if you advocate granting immigrants also legal status you are in a different case and it is no more obvious why your argument is correct. It is probably false.

There is also a problem for the opposite position. For years, restrictionists in Europe have been making the argument that there are hundreds of millions who would like to immigrate, and all that’s keeping them back are strict border controls. So you would see an exodus once you relaxed enforcement. That cannot be true either. As long as you have enforcement within the country and there is no legal status, numbers have to stay rather modest for illegal immigrants (note: this does not have to apply to those who enter the country perhaps illegally, but who have a chance of obtaining legal status like asylum seekers or refugees in a narrow sense).

For legal immigration, the regime at the border is unimportant. And there is no such constraint on the supply of jobs for immigrants (or only in the short run). Hence the conclusion from low numbers of illegal immigrants and little sensitivity to the level of enforcement at the border does not carry over to the number of legal immigrants if other policies change. Granting more people legal status could mean very high numbers. Confounding the two cases is just a category mistake.

To sum up:

  • If you understand “open borders” as no enforcement at the border, but no legal status, and enforcement within the country at a level as for developed countries now, then there should be a rather low bound for the percentage of illegal immigrants. Empirical evidence would suggest a range in the lower single digits.
  • The main constraint is probably the labor market for illegal immigrants, which has to be a part of the shadow economy. And for developed countries, there appears to be a constraint on the size of the shadow economy, perhaps in the lower single digits as a percentage of the official economy. This implies a rather stringent bound on the number of jobs available for illegal immigrants. Combined with very many potential immigrants, changes in the border regime could make only a small difference for the stock of illegal immigrants, all else equal. The stock should react strongly to the state of the economy, though.
  • If you understand “open borders” as granting legal status and the right to settle and work in the country as for domestic citizens, then the regime at the border is unimportant. There is no apparent bound for the number of immigrants, and the numbers in global polls could well materialize. Lumping illegal and legal immigration together is not warranted.  The two cases are quite distinct.

The Immigrant Has a Right to Compete for Your Job

Many economic arguments have been made for why the non-citizen should be permitted to work in the United States. Many have argued that immigrants don’t compete materially with American for jobs, that they only compete with very “low-skilled” U.S. citizens for jobs, or only suppress wages by marginal and ultimately insignificant amounts, or that, regardless of competing slightly for already existing jobs, migrating people also create jobs and economic growth anyway, offsetting any competition.[i] Even I have made these arguments.[ii] But all of these arguments, while compelling and true, miss the point: it really doesn’t matter if immigrants compete with U. S. citizens for jobs- because the jobs in the U.S. do not belong to Americans – they belong to everyone because everyone has a right to survive.

The Right to Work Follows From the Right to Life, Despite Racist Law

The right to life is recognized under both American[iii] and international law.[iv] Unfortunately, the law does not recognize, either domestically[v] or internationally,[vi] that the right to life means the right to cross a border to access the means of survival, such as employment.[vii] Nonetheless, if people have a right to live, and people need to work to live, it follows that people have a right to work. So, while the right of all people to compete for the same job does not follow legally – it does follow logically and morally. The law, as is so often the case, just hasn’t caught up to the morality yet. But the law has not caught up to the morality yet because, while the right to work may follow morally, it does not follow politically.

It does not follow politically because it does not follow racially. White supremacy is naturally opposed to truly color blind and nationality blind, work opportunity. The artifice of white supremacy that says locus of birth dictates whether or not you have a right to survival, long ago found an expression in the law. This vehicle of expression is called the plenary power doctrine.

Like many platforms for white supremacy (e.g., the war the drugs[viii]), the plenary power doctrine hides behind ostensibly race-neutral concepts. On its face the plenary power doctrine says that a nation state is sovereign, meaning it has a right to self-determination, and therefore has a virtually unconditional right to exclude any non-citizen it wants from its territory, for whatever reason it wants, when and (more or less) however it wants.[ix] While generally, the constitution and its protections attach to any person in U.S. territory,[x] the doctrine still effectively allows Congress to eject non-citizens and especially “undocumented” non-citizens from that territory or deprive them of equal treatment basically, willy nilly.[xi] Practically, this means sovereignty absolves our society from any moral duty whatsoever to any human being that is not a citizen of the nation state. In other words, it exploits and abuses the idea of self-determination to vanquish totally the humanity of any human life that is not a citizen. Since citizenship is traditionally tied to race and nationality, and is, I would argue, an unalterably racialized idea,[xii] the ability of this sovereign-supremacy doctrine to serve white-supremacy should be obvious.

The reader may disagree that nationality is an inherently racist idea, but that does not change my moral obligation to call a fig a fig. It is impossible for me to ignore that the practical function of nationality is to allow different rules to apply to different people based on an assigned national label; a label which is itself defined by immutable (e.g., locus of birth, lineage) or non-meritorious traits (e.g., language or religion) – in a word, racism. It is a means to rationalize violence. In an employment context, economic violence.

Actually, Supreme Court Justice David Josiah Brewer, in a dissenting opinion from a late nineteenth century case that discussed the plenary power doctrine, made a not entirely dissimilar criticism of the doctrine than that one I am making right now:

It is said that the power here asserted is inherent in sovereignty. This doctrine of powers inherent in sovereignty is one both indefinite and dangerous. Where are the limits to such powers to be found, and by whom are they to be pronounced? Is it within legislative capacity to declare the limits? If so, then the mere assertion of an inherent power creates it, and despotism exists. May the courts establish the boundaries? Whence do they obtain the authority for this? Shall they took to the practices of other nations to ascertain the limits? The governments of other nations have elastic powers. Ours are fixed and bounded by a written constitution. The expulsion of a race may be within the inherent powers of a despotism. History, before the adoption of this constitution, was not destitute of examples of the exercise of such a power; and its framers were familiar with history, and wisely, and it seems to me, they gave to this government no general power to banish. Banishment may be resorted to as punishment for crime; but among the powers reserved to the people, and not delegated to the government, is that of determining whether whole classes in our midst shall, for no crime but that of their race and birthplace, be driven from our territory.[xiii]

Indeed, the idea that the plenary power doctrine is anything other than a racialized effort to diminish the humanity of others via banishment is belied by the very case law that articulated the doctrine. The seminal cases on the plenary power doctrine, Nishimura Eiku v. U.S.,[xiv] and Fong Yue Ting v. U.S.,[xv] were failed efforts to challenge the Chinese Exclusion Acts, explicitly racist exclusionary laws that prohibited Asian immigration. That the U.S. Supreme Court used an ostensibly race-neutral doctrine to procure an unambiguously racist result that upheld an equally racist law makes suspect the allegation that the doctrine is race-neutral and reveals the true motivation behind the doctrine and the Supreme Court decisions that kept it law.

Nonetheless, today the plenary power doctrine is the legal foundation of the federal government’s power to restrict immigration and permit discrimination, such as restricting which benefits non-citizens may receive, including work opportunity.[xvi] In this way the plenary power doctrine is the most powerful legal tool for protecting (white/american) privileged access to jobs and obstructing the right to life and survival for non-citizens. The argument that marginalized group A is “taking” the work that hegemonic group B has a superior right to is not new. It was wielded against black citizens and citizen women to exclude them from work as well. This exclusion not only gave white men privileged access to wages but also generated a source of cheap labor. As Aviva Chomsky notes in her book They Take Our Jobs!: And 20 Other Myths About Immigration, marginalizing a group of people, be it women or blacks, provided a cheap source of labor for white men, just as marginalizing immigrants does now:

For centuries, the United States and other industrialized countries have institutionalized inequalities by granting rights to some people but not to others. People without rights may be slaves, they may be colonial subjects, they may be racial and ethnic minorities, or they may be immigrants . . . In all cases, though, governments have made sure that there are people without rights to fulfill buisness’s need for cheap workers and high profits.[xvii]

Making the immigrant’s right to work less than the citizen’s right performed the same function today as it did before – shutting out equal opportunity of some group performs the dual purpose of both hoarding wages for the privileged few and creating a cheap source of labor to benefit them. That kind of privilege is just a rationale for brutality.

American Jobs Belong to the World

If everyone has the right to compete for jobs regardless of locus of birth and nationality than no one’s right is superior to anyone else’s. The non-citizen with permission to work is not morally superior to the non-citizen without that permission. They are not more deserving, they are not more accomplished, and they can prove no greater claim to the opportunity. The employment authorization card is issued without the moral authority to issue it: No one should need another person’s permission to survive. To propose that any person or institution has the right to give that permission is an argument against equality. Either everyone who needs to work has the right to work, or no one does.

To horde your local work opportunity for yourself is not just racist – it is also selfish. It is an act of destructive hedonism, a victory for shameless narcissism. The person who endorses “our jobs, not theirs” must admit they enrich themselves at the expense of another. They embrace an amoral, me-first universe and spit on the golden rule. There is no dignifying the law of the plenary power doctrine – it is the mindless law of the jungle masquerading as jurisprudence. Its true purpose is for “determining whether whole classes in our midst shall, for no crime but that of their race and birthplace, be driven from our territory.”

The jobs in the United States belong to the world, to the nation of Humanity, not just to the tribe of Americans. You may insist that you have a superior right to compete for that job in your neighborhood because you accomplished the dumb task of being born closer to it than someone else, but you would be wrong. Of course immigrants bring jobs, but that’s irrelevant because they have a right to compete for existing jobs. Will you lose a job if an immigrant is hired in your place? Of course you will, that’s how sharing works. That’s what equality looks like. Does that mean you may have a duty to make sacrifices so that others might live? Yes, that’s how morality works. Henry David Thoreau, making an argument against slavery that could easily double as an argument against work restrictions, once put it thusly:

If I have unjustly wrested a plank from a drowning man, I must restore it to him though I drown myself. . . But he that would save his life, in such a case, shall lose it. These people must cease to hold slaves . . . though it cost them their existence as a people.[xviii]

Morally, it doesn’t matter if immigrants produce jobs, because they also have a right to compete for your job and my job. No non-citizen can take your job, in fact, because it isn’t yours. But if you are someone who insists on the contrary, curmudgeon myth, for as long as you insist on it, as an immigration lawyer I will insist on aiding as many people as possible to survive by helping them get work permission in the United States – as far and as often as the law allows me. I will work hard to pry what is not yours from your stubborn, selfish hands.

No Human Should Be Documented

Earlier this month Libertarian presidential candidate Gary Johnson made it clear that he was against using the term ‘illegal immigrant’ and that he preferred the term ‘undocumented’. The issue of what to call illegal aliens is often discussed, see John Lee’s previous post and the general page on the topic.

Conservatives object to calling illegal aliens “migrants” on the grounds that it justifies their actions as a viable form of migration. Some in the alt-right go as far as to claim that “alien” is the proper term as it makes it clearer that ‘white’ countries are being invaded. The left on the other hand objects to the term “illegal” as it dehumanizes individuals. No human is illegal – so goes that slogan. The alternative term proposed is “undocumented”.

I am indifferent to the distinction between migrant and alien. I have to resist chuckling when I hear someone seriously worry about illegal aliens invading. Can I be blamed? My home state of California is littered with Spanish place names – Los Angeles, San Francisco, San Jose, San Diego, etc. What would the point of an invasion be at this stage? To rename Bakersfield to San Panadero?

It is the promotion of the term “undocumented” term that concerns me. Just as no human is illegal, I see no reason why we should promote the idea that humans should be documented. To me being “documented” conjures up the image of a dystopian future where we are branded with identification numbers that are needed for every little transaction. Indeed, I consider the term undocumented to be worse than illegal since it implies that all individuals, including natural born citizens, should be documented in this manner. At minimum the term implicitly justifies a program like e-verify, a de facto form of national ID in the United States, which makes one’s right to work dependent on government approval.

This is not to mean that an open borders regime would do away with all forms of identification. It would be possible to still require potential migrants to undergo a background check in order to screen out criminals. However there is a difference between a background check and requiring everyone, migrant and natives alike, to constantly present documentation.

Both terms then, illegal and undocumented, should be objected to. Alternative terms have similar failings. “Dreamer”, a moniker used to describe to illegal aliens who entered as children and are pursuing higher education, implicitly suggests that “normal” illegal aliens should be deported. “Unauthorized” still implies, if subtly, that states have the right to restrict migration.

I personally prefer the term illegal alien because, at least in the United States, I think open border advocacy needs to be focused towards conservatives. This is not to mean that the left has embraced open borders mind you, but there are more leftists in the movement than conservatives. I am willing to concede the terminology debate if it means that there is more time to make the rest of the case for open borders.

Political considerations aside, what should these individuals be called? I think the answer should be obvious to open border advocates: humans. Under open borders all individuals are humans with the same inherent rights.

Open Borders and the Golden Rule

Last year Pope Francis visited the United States and addressed Congress. A significant portion of his speech was devoted to how people should respond to immigrants. While not appealing for specific immigration policies, Pope Francis reminded his listeners that immigrants deserve to be treated humanely:

“… thousands of persons are led to travel north in search of a better life for themselves and for their loved ones, in search of greater opportunities. Is this not what we want for our own children? We must not be taken aback by their numbers, but rather view them as persons, seeing their faces and listening to their stories, trying to respond as best we can to their situation. To respond in a way which is always humane, just and fraternal. We need to avoid a common temptation nowadays: to discard whatever proves troublesome. Let us remember the Golden Rule: ‘Do unto others as you would have them do unto you.’ This Rule points us in a clear direction. Let us treat others with the same passion and compassion with which we want to be treated. Let us seek for others the same possibilities which we seek for ourselves. Let us help others to grow, as we would like to be helped ourselves.”

Open borders supporters can highlight certain remarks that appear to support our cause, especially the sentence “Let us seek for others the same possibilities which we seek for ourselves.” For immigrants from developing countries to enjoy the same opportunities as people living in developed countries, they must be allowed to enter and remain in advanced countries. And it seems impossible to treat immigrants in a way that is “humane” and “just” under a policy of restrictions. (The group No One Is Illegal states that “the achievement of fair immigration restrictions… would require a miracle.”) At the same time, those opposed to open borders could reference a remark in the Pope’s speech (not quoted above) in which he states that the world refugee crisis “presents us with great challenges and many hard decisions.” One might infer that those decisions might involve accepting some migrants into destination countries and refusing others.

But what about the Golden Rule itself? Is it a foundation for open borders? One approach to the Golden Rule would seem to support open borders. Consider Bryan Caplan’s remark that all that we really owe strangers is to leave them alone. If this is applied universally, “Do unto others…” could mean that you wouldn’t have anyone block you from shopping, living, or working where you please, even if it’s in another country, so you shouldn’t interfere with others’ ability to do the same, regardless of their nationality. This seems to be what the Pope means when he says, “Let us seek for others the same possibilities which we seek for ourselves.”

The Golden Rule also could be seen as supporting a limited version of open borders. It would support open borders for citizens of countries with comparable economic prosperity. For example, Argentina, Chile, and Uruguay have roughly the same per capita GDP.  It would make sense that citizens of any one of these countries would have the other two countries allow them to migrate freely to those countries to pursue economic opportunities, so they should have open borders for citizens of the two other countries to enter their country.

However, the Golden Rule’s support for open borders could founder when applied to citizens of countries with wide economic disparities. This is because citizens of the Third World generally have much more to gain from moving permanently to the First World than citizens in the First World have to gain from moving permanently to the Third World. Citizens of developed countries, who generally have little desire to migrate to developing countries, probably wouldn’t have developing countries open their borders to them, especially if it meant they would have to, under the Golden Rule, reciprocate. Therefore, they wouldn’t be obligated to open their borders to citizens from developing countries. For example, most Canadians likely would be okay with Bangladeshis telling them that they couldn’t migrate to Bangladesh, so Canadians wouldn’t have to open their borders to Bangladeshis. On the other hand, most Bangladeshis probably would have Canada open its borders to them, so they would have to open their borders to Canadians. This difference in perspective reflects a weakness that others have noted about the Golden Rule: the difficulty of applying it to “differences of situation.

Pope Francis’ comments about treating immigrants with compassion are inspiring. However, I disagree that the Golden Rule “points us in a clear direction” about how to respond to immigration. It is too malleable to provide a moral foundation for immigration policy.
