The illusion of self-determination

The right of a people to determine its own fate—national self-determination—is one of pillars of the Westphalian model of world political order holding nation-state sovereignty as its core principle. It also underpins most philosophical defenses of the right of nation to control who moves across its borders and who can join its citizenry.

Here at the outset I’d like to submit that, provisionally, the principle of national self-determination makes a fair bit of sense. The principle was included in the Westphalian model in order to minimize war (capably discussed by my co-blogger in this post). It proscribes invasions of foreign lands for causes like defending or advancing a religion or ideology, for instance. After all, the birth of Protestantism was the proximate cause of the Thirty Years War which ended with the Treaty of Westphalia and the principle of national self-determination.

But the presumption in favor of national self-determination can be overridden in certain circumstances. I take it as mostly uncontroversial to say that if a genocide is underway within a nation’s borders, national sovereignty carries insufficient moral weight to prevent a humanitarian intervention (even if, say, military intervention is ruled out for pragmatic reasons, it isn’t respect for sovereignty that restrains those who would intervene). More importantly (and less dramatically), I’d like to suggest that the principle of self-determination loses coherence when it strays too far from its primary task of protecting a population against external threats of violence.

To bring this to migration, national self-determination is often appealed to in order to justify the right of a state to limit its membership. Michael Walzer, the distinguished communitarian philosopher, has argued in his book, Spheres of Justice, that the authority to limit membership of the national community is fundamental to national independence.

Admission and exclusion are at the core of communal independence. They suggest the deepest meaning of self-determination. Without them, there could not be communities of character, historically ongoing associations of men and women with some special commitment to one another and some special sense of their common life.

In his essay, Immigration: the Case for Limits (found in this book), David Miller has also defended the right of the citizens of a nation to exclude migrants at the border on the basis of cultural continuity:

[T]he public culture of their country is something that people have an interest in controlling: they want to be able to shape the way that their nation develops, including the values that are contained in the public culture. They may not of course succeed: valued cultural features can be eroded by economic and other forces that evade political control. But they may certainly have good reason to try, and in particular to try to maintain cultural continuity over time, so that they can see themselves as the bearers of an identifiable cultural tradition that stretches backward historically.

The ability to preserve culture is fundamental to self-determination-based defenses of controlled borders. “The distinctiveness of cultures and groups depends upon closure. … If this distinctiveness is a value … then closure must be permitted somewhere.” (Walzer again) Given the persevering cultural distinctiveness that can be observed among the several states of the USA and among nations within the European Schengen area of porous borders, for a couple examples, it seems like this concern may be overwrought. Indeed, cultural distinctiveness can even be observed among various neighborhoods within individual multicultural metropolises around the world. Nonetheless, the preservation of national cultural distinctiveness has a strong and intuitive appeal. In Migration and Morality: a Liberal Egalitarian Perspective (found in this anthology), Joseph Carens—a friend of liberal migration if ever there was one—sketches out a case for limiting immigration for the sake of preserving culture as one of the few acceptable—in principle—justifications for limiting migration. He argues that Japanese culture, for example, would be worth preserving even to the inconvenience of would-be immigrants. This argument can only go so far, however, for he concludes that this cultural preservation can’t overcome the claims of migrants whose basic needs are not being met.

[M]ost people in Japan share a common culture, tradition and history to a much greater extent than people do in countries like Canada and the United States. It seems reasonable to suppose that many Japanese cherish their distinctive way of life, that they want to preserve it and pass it on to their children because they find that it gives meaning and depth to their lives. They cannot pass it on unchanged, to be sure, because no way of life remains entirely unchanged, but they can hope to do so in a form that retains both its vitality and its continuity with the past. In these ways many Japanese may have a vital interest in the preservation of a distinctive Japanese culture; they may regard it as crucial to their life projects. From a liberal egalitarian perspective this concern for preserving Japanese culture counts as a legitimate interest, assuming (as I do) that this culture is compatible with respect for all human beings as free and equal moral persons.

It also seems reasonable to suppose that this distinctive culture and way of life would be profoundly transformed if a significant number of immigrants came to live in Japan. A multicultural Japan would be a very different place. So, limits on new entrants would be necessary to preserve the culture if any significant number of people wanted to immigrate.

Carens anticipates the most obvious counter that restricting immigration limits real individual freedoms for the sake of what is essentially a “by-product of uncoordinated individual actions” that does not itself violate any individual’s rights.

The problem with this sort of response (which clearly does fit with some strains in the liberal tradition and even with some forms of liberal egalitarianism) is that it uses too narrow a definition of freedom. It excludes by fiat any concern for the cumulative, if unintended, consequences of individual actions. A richer concept of freedom will pay attention to the context of choice, to the extent to which background conditions make it possible for people to realize their most important goals and pursue their most important life projects. That is precisely the sort of approach that permits us to see the ways in which particular cultures can provide valuable resources for people and the costs associated with the loss of a culture, while still permitting a critical assessment of the consequences of the culture both for those who participate in it and for those who do not.

The problem with Carens’s “richer concept of freedom”—which I acknowledge is real and worthy of consideration—is that it is difficult to conceive of a legitimate ownership of it. Who decides which aspects of “traditional” society are worth preserving (at the cost of more focused and observable individual freedoms, let’s not forget) and which aspects are merely parts of inevitable cultural evolution? The “by-products of uncoordinated individual actions” can presumably manifest as cultural improvements, and not just “erosion”, as Miller seems to assume. Some things (Islam, manga comics, or capitalism, for a few examples) that may represent cultural decay to some will be embraced by others as beneficial innovation, and it’s difficult to say who would be right in such a contest of values. Should a committee of bureaucrats be set up to decide which foreign influences are acceptable cultural adaptations, the way the French have circled their wagons around the integrity of their language? Even if such a committee were popularly elected, it’s difficult to see how that democratic mechanism would achieve any greater legitimacy than uncoordinated individual actions.

The larger point I want to make is that restricting immigration for the sake of cultural preservation is ineffective to the point of quixotic. There are other influences that will impact culture, influences that cultural preservationists are less willing to stifle by coercion. Indeed in the quotes above Carens and Miller both recognize that culture evolves in ways that “evade political control”. The first of these purely internal. Culture, including language, social values, artistic (literary, musical, etc) expression, and political values can and do all change as a result of younger generations challenging the ideas and practices of their forebears. This process of change over generations may be exacerbated by outside influences, but it would be hard to deny that at its core it is a natural phenomenon at work even in closed societies. I think the relatively recent and rapid expansion of the gay rights movement in America is a good example of this. It has seemed primarily domestic in origin (the fact that some other countries have possibly made greater strides in gay rights hasn’t been particularly influential), and the level of acceptance of gays and lesbians in society is famously starkly divided between young and old folks. The Civil Rights Movement of the 1960s can likewise not be said to be imported, as the legal and cultural legacy of southern slavery and the long reign of Jim Crow were peculiar to American history. Less politically, musical innovations like rock & roll, entertainment innovations like video games and the mobile solitaire app, and linguistic innovations like African American Vernacular English have not needed outside influences to sprout and evoke consternation among parents and other squares.

It isn’t even clear that anyone notices the difference between cultural innovation by natives and that by outsiders. Invention from the outside can “go native” as well as a person can. Carens’s example of Japan gave me an excuse to read about the history of manga, an art form I think I can safely describe as distinctively Japanese. Five minutes of research unearthed a surprisingly mongrel history, including its inspiration by a nineteenth century British cartoonist and “U.S. cultural influences, including U.S. comics (brought to Japan by the GIs) and images and themes from U.S. television, film, and cartoons (especially Disney).” The desire to protect a national culture from outside influences seems to ignore the ability of those same cultures to ingest, adapt, and own inputs from the outside, all in bottom-up fashion without need for supervision from any cultural defenders at the top.

Technological innovation can radically change the contours of a society and isn’t intrinsically related to immigration. The Industrial Revolution destroyed old occupations and enabled people to leave rural life en masse. Widespread rail networks and the adoption of the automobile made the world a smaller place, even within nations. Electrification, radio, television, the airplane, the printing press, the integrated circuit, and the Internet have all profoundly changed human life and the ways individuals relate to each other and wider society. The birth control pill empowered women to control their own sexual and reproductive lives and enabled them to pursue opportunities in the world outside the home (occupational, educational, political, etc). All these innovations have arguably changed national cultures on a scale greater than anything widespread immigration could likely achieve.

It could be argued that the American examples above do not actually serve my cause since America is so famously and fundamentally shaped by immigration. And it could be argued that the technological innovations I mentioned and the ways they undoubtedly transformed societies are nonetheless irrelevant to the present discussion: technological changes affecting the whole world can be adapted to different national cultures in unique ways and so perhaps the point is more that each national culture must be allowed to express itself through technological advancement in its own way. Technological change is, of course, not all homegrown, but it spreads through international avenues other than migration, avenues which most immigration restrictionists would not attempt to close.

Ideas are spread through trade between nations, through travel and tourism, through international communications and media, and through common international gatherings like professional conferences and sporting events. Good ideas (and bad ones), will find ways to spread whether there are appreciable levels of migration or not. International migration will surely speed up cultural change, but it’s not the only driver of change, or even the most important one. Yet the focus of the argument for national self-determination is always on preserving the right of a nation’s sovereign authority to restrict entry of new members, and little ink is spilled advocating closing off these other pathways of social change. Given the long odds of meaningfully preserving national culture (however it is defined), and the apparent lack of enthusiasm for protecting it from equally powerful mechanisms of change,  it is fair to ask, Why does immigration warrant such special treatment?

Immigration restrictions are a threat to liberty everywhere

In the civil libertarian world today, two issues rule the roost: surveillance and drones. Ordinarily civil rights issues like these find it difficult to gain traction, but increasingly it looks like even the mainstream media can’t ignore these issues. Spying on the behaviour of millions of innocent people, and murdering innocent people (AKA “collateral damage”) from a remote-controlled airplane, are difficult things to readily reconcile with modern ideas of human rights and freedoms. These issues make me think: how long before civil libertarians begin to comprehend the danger of similar totalitarian disregard for liberty in immigration policy?

Drones are primarily a concern for people burdened by the welfare of innocent people in war zones. Innocents in Yemen, Afghanistan, and Pakistan live daily in fear of an errant missile strike, meant for another, but still deadly to all innocents in its path. The policy for deploying drones, and launching their weaponry, until recently has been near-entirely opaque (some would argue it is still entirely opaque). What due process do we have to ensure that drones won’t recklessly murder dozens, hundreds, of guiltless people, in search of taking out one terrorist? What assurances can we give innocents that an overzealous government bureaucrat can’t use his discretion to murder innocent human beings?

The rationale for the US government’s National Security Agency surveillance programmes has always been: we spy on foreigners’ data, not our own. The NSA still maintains it protects US citizens’ data rigorously, though there are many reasonable doubts that this is true. Edward Snowden’s revelations, even if reconciled with the NSA’s claims about protecting US nationals’ data, still ring alarm bells for American civil libertarians: how easy might it be for the NSA to turn the same lens it has trained on foreigners onto us instead? In 1975, US Senator Frank Church warned of such surveillance:

That capability at any time could be turned around on the American people and no American would have any privacy left, such [is] the capability to monitor everything: telephone conversations, telegrams, it doesn’t matter. There would be no place to hide. If this government ever became a tyranny, if a dictator ever took charge in this country, the technological capacity that the intelligence community has given the government could enable it to impose total tyranny, and there would be no way to fight back, because the most careful effort to combine together in resistance to the government, no matter how privately it was done, is within the reach of the government to know.

Since I blog for Open Borders, you would be wise to surmise that neither drones nor NSA surveillance are issues I think about much. But like millions of others, these are issues that weigh on me nonetheless. It worries me that innocent people are subject to murder by the state without due process. It worries me that innocent people are subject to surveillance by the state, again, without due process. And I know these worries all too well, for as an immigrant and someone who enjoys reading stories of immigration, I have seen just how utterly the modern state throws due process in the garbage the moment an immigrant crosses the threshold.

I’ve written before about how perplexed I am that civil libertarians devote a disproportionate amount of energy to criticising allegedly dehumanising air travel procedures. I’m glad to see that deserving due process issues are taking up more attention than ever before. But civil libertarians need to add another issue to complete their trifecta of due process concerns: drone murder, arbitrary surveillance, and arbitrary restriction of human movement. The simplicity and fairness of open borders is not just a nice-to-have; it is critical for a just and fair legal process.

I and others have written time and time again about how modern immigration procedures recklessly abandon due process. Ask yourself: did the refugees whose files were wheeled past a UK Minister so civil servants could “truthfully” tell Parliament that a Minister had duly reviewed their applications get justice? Did they get due process? How about the Brazilians whose visa applications were rejected because a US consulate decided that black visa applicants must be poor? Did they get due process?

Any US consular officer is entitled to reject most visa applications for any reason they like. This “consular nonreviewability” discretion, by US law, cannot be challenged in court or overruled by senior officials — not even the President. Since 1990, the American Bar Association has persistently asked the US government every year to  “establish increased due process in consular visa adjudications and a system for administrative review of certain visa denials, including specified principles” — a request that has consistently fallen on deaf ears. In 2005, the US State Department issued a report recommending further reductions in existing due process and more discretion for consular officials.

It would be one thing if this due process brouhaha focused on police officers arbitrarily writing speeding tickets (as they often seem to be doing in many jurisdictions). But this lack of due process tears families apart. It destroys jobs. Imagine if you lost your job because your employer claimed you were a drug smuggler (based on your name resembling someone else’s, who actually is a drug smuggler) — and you had no right to challenge that claim in court. That actually happened to one unlucky immigrant in the US. A lack of legal due process harms real human beings; it breaks hearts and homes.

It is no consolation that the government is only empowered to take your spouse and children away from you, or fire you from your job, if you’re a foreigner. As Senator Church warned in 1975:

I don’t want to see this country ever go across the bridge. I know the capacity that is there to make tyranny total in America, and we must see to it that this agency and all agencies that possess this technology operate within the law and under proper supervision, so that we never cross over that abyss. That is the abyss from which there is no return. (emphasis added)

A government powerful enough to arbitrarily evict your neighbour from his home, take him away from his family, and take his livelihood away from him, is powerful enough to do that to you too. One remarkable thing I’ve found about the debate surrounding drones and surveillance is that the people criticising them often also implicitly criticise a focus solely on the well-being of citizens, urging us to account for these policies in the totality of their effects on innocent human beings, regardless of nationality. I do not think this criticism of citizenism has struck that much of a chord with the masses — Glenn Greenwald may worry about the innocent Afghan victims of drones, or innocent British victims of surveillance, but the median news media consumer probably does not.

However, these issues resonate, because people appreciate the risk of giving government too much power — the power to kill and the power to spy without the process of law or supervision. Perhaps people need a similar awakening about the power of government to keep you alive while taking away everything you hold dear — your home, your job, your family. That the victims are mere foreigners should be little consolation. A government powerful enough to do anything without due process is powerful enough to make a victim of you too.

Cosmopolitanism and open borders: a follow-up

After I wrote my post on the apparent lack of interest in open borders among cosmopolitans, I received some comments offering some contrary evidence. While, as an advocate of open borders, I remain disappointed with the book I referenced in that post (though more generally as a student of cosmopolitanism I happily recommend The Cosmopolitanism Reader), I believe I was premature in claiming cosmopolitans have unduly ignored migration.

First, even if most of the mentions of migration and border controls in the book are cursory, some of the contributors have substantively commented on migration elsewhere. Brian Barry, one of the contributors to the part titled “Cosmopolitan Global Justice” that focused so much on global distributive justice, mostly ignored movement across borders in his essay. Yet he also edited a book in 1992 titled Free Movement: Ethical Issues in the Transnational Migration of People and of Money (which I have not read fully).

Simon Caney, another contributor, has also discussed migration separately. In a 2006 paper he admirably brought the sometimes abstract discussions of global justice into the practical realm of policy by comparing a dozen (ostensibly) cosmopolitan policies, one of which was open borders. He proceeds by defending the policy against the charge that open borders would not actually benefit the world’s poor:

Maybe the upshot will simply be that talented and able-bodied people will migrate, leaving the most vulnerable behind and unprotected. This is no doubt a risk but two points should be made in reply. First, recent evidence from the World Bank and elsewhere does indicate that migration aids the global poor. It is important to recognize here that migration generates two distinct kinds of beneficial effects. First, it improves the standard of living of the migrants and, second, migrants send remittances to their family members who remain in the home country and so the latter too can benefit from migration. So the beneficiaries include not simply those who leave (who are likely to be able bodied and skilled) but also those who are not able to leave to seek work. In its 2006 report entitled Global Economic Prospects: Economic Implications of Remittances and Migration, the World Bank found, for example, that the amount of money sent as remittances to developing countries was likely to be approximately $167 billion in 2005 and it has increased by 100% in five years […]. The report further adds that ‘remittances have been associated with declines in the poverty headcount ratio in several low-income countries—by 11 percentage points in Uganda, 6 in Bangladesh, and 5 in Ghana, for example. […]

Other cosmopolitan thinkers were also brought to my attention, including Phillip Cole, who has written two books on the ethics of immigration (or one and a half: the second was co-written with Christopher Heath Wellman, who argued for the right of states to restrict immigration. Phillip Cole has been discussed on this site previously here). I am not sure Cole considers himself a cosmopolitan, but he is certainly a fellow traveler, basing his arguments on the moral primacy of the individual and universalizing this primacy by applying it to every individual.

Likewise, Joseph Carens is an ethicist with whom I was already familiar (and who has been discussed on this blog previously), but I didn’t include him in the original post because I’ve never seen him adopt the cosmopolitan label. But focusing too much on labels can be unproductive. Carens has been writing about the ethics of migration for decades, with one classic essay, Migration and Morality: a Liberal Egalitarian Perspective, appearing in Barry’s book mentioned above. In this essay he stakes out the position, similar to that advanced by this site, that “Liberal egalitarianism entails a deep commitment to freedom of movement as both an important liberty in itself and a prerequisite for other freedoms. Thus the presumption is for free migration and anyone who would defend restrictions faces a heavy burden of proof.” Carens has continued his work in defending free migration to the present: Amazon tells us he has a book forthcoming on the subject in December.

Arash Abizadeh is a political philosopher at McGill University of a cosmopolitan bent who has defended open borders in a number of recent papers. In one especially novel paper (pdf), he defies the conventional wisdom that democratic principles and liberal egalitarian principles come to loggerheads on the issue of border control. He proposes that, because border control is coercive to individuals seeking to cross borders, democratic legitimacy requires that the migrants (those on the business end of coercion) must be given some democratic say in the matter.

According to the state sovereignty view–the dominant ideology of the contemporary interstate system–entry policy ought to be under the unilateral discretion of (the members of) the state itself, and whatever justification is required for a particular entry policy is simply owed to members: foreigners are owed no justification and so should have no control over a state’s entry policy. What I seek to demonstrate is that such a position is inconsistent with the democratic theory of political  legitimation domestically is thereby committed to rejecting the unilateral domestic right to control and close the state’s boundaries, whether boundaries in the civic sense (which regulate membership) or in the territorial sense (which regulate movement).

Obviously I cannot exhaustively cover all the cosmopolitan and cosmo-curious thinkers who have discussed the ethics of migration in this post. A brief dip in the literature has turned up more than I originally thought I would find based on my introductory text. I’d like to close with perhaps my most encouraging find. Gillian Brock, in her 2009 book Global Justice: a Cosmopolitan Account, devoted a whole chapter on immigration. An adapted excerpt of the chapter was published on openDemocracy. Brock is not opposed to increased migration per se, but she expresses skepticism that freer migration will advance global justice if unaccompanied by policies mitigating perceived adverse side effects of liberalized emigration from poor countries. Specifically, she contends brain drain effects on sending countries can outweigh the positive effects on host countries and the migrants themselves, especially in the case of health workers.

I plan to address Brock’s concern about the “brain drain” in another post, but for now I want to point to the attention her arguments received among other cosmopolitans. The journal Global Justice: Theory Practice Rhetoric (mercifully ungated) hosted a special issue in 2011 to discuss her book. Two of the response essays focused on Brock’s treatment of migration, criticizing her skepticism of freer migration policies. The journal editors, perhaps sensing the wide interest in the topic, then devoted their 2012 issue to migration and its relationship to global justice. Even when cosmopolitans oppose unrestricted movement or hedge their arguments against it, they offer a refreshing point of view. In a debate where so often advocates of open borders struggle to get our interlocutors to acknowledge that the rights and preferences of would-be migrants warrant our consideration at all, skeptical cosmopolitans on the contrary fear that we may have insufficiently considered the effects on all of the relevant affected people. The coverage of migration by cosmopolitan philosophers is more substantive than I thought, and it’s heartening to see that, if anything, interest in the subject has deepened in recent years.

A case for open borders that is radically agnostic about migrant count

In a previous post, I considered the considerable divergence, even among open borders advocates, about the raw count and selectivity of migrants under open borders. I argued that it is important to get more clarity on these questions, including understanding the source of disagreement and how different views regarding these can affect the other estimates (including economic growth estimates) related to open borders.

In this post, I attempt to sketch several arguments that could form building blocks of a case for open borders that is radically agnostic about how many people would move.

The right to migrate argument

This argument states, simply, that people have a right to migrate. Denial of this right is immoral. How many people would end up choosing to exercise that right is not of direct relevance. Migration restrictions are immoral because they prevent a large number of people who are in a position where they may wish to exercise the right from doing so. The human capabilities case for open borders is somewhat similar.

The lower bound argument

This argument states that even the lowest possible estimate of how many people would actually move under open borders (perhaps such estimates can be obtained by looking at the number of people who have moved under relatively modest migration liberalization regimes) is high enough to make open borders worthwhile. Whether we are talking of 10 million people over a decade or 200 million people over 2-3 years, open borders would have huge impact.

The “it anyway won’t happen immediately” argument

This argument views open borders as a goal we should set our sights on as we gradually work towards it. Thus, determining the numbers of people who’d migrate under complete open borders is at best an illuminative theoretical exercise and at worst a distraction from the more important goal of seeking marginal change that is far better understood. Some proponents of this argument many view open borders advocacy as a means for shifting the Overton window in a manner that makes immigration liberalization appear to be a more “moderate” position.

The “market forces will prevent swamping” argument

One of the concerns that critics of open borders have is that under open borders, countries (mostly rich countries) that are attractive targets for immigrants will get swamped with large numbers of migrants. This is part of the motivation behind the desire to estimate how many would move under open borders. Some open borders advocates believe that market forces, loosely defined, will take care of this concern. If too many immigrants are moving into the area, rents and other prices will rise and wages will fall to the level that it is no longer attractive to move to the destination. Other non-pecuniary negative feedback loops may also counter the swamping threat. Many people use phrases like “migration flows tend to be self-regulating” to describe this perceived phenomenon.

The “however much it takes to attain labor market convergence” argument

This argument states that migration will continue until there is (upward) labor market convergence between the sending and receiving countries. Convergence may not be complete, but may stop when the place premium between the two countries is a factor of 1.5 or less (i.e., there is only a ~50% wage gain from migrating). The point here is that we don’t know for sure how many people would need to move in order for this convergence to occur, because of countervailing factors: governments may begin instituting economic reforms once people start leaving en masse, emigrants may return to the country to set up new factories and business connected with other countries, etc. Or, this may not happen. Uncertainty about how things play out result in considerable agnosticism about the number of people who move, but relatively more certainty about the nature and desirability of the eventual outcome for humanity.

Immigration And Property Rights

Opponents of immigration often compare nations to households. Under this analogy, citizens are members of the household, while an illegal immigrant is “like a roommate who doesn’t pay the rent.” We wouldn’t allow someone to barge into our household and use all of our private property, so why would anyone allow an immigrant to barge into a country and attempt to find a job?

Weaknesses of this analogy aside, it rests on a view of property rights that is perhaps best outlined here by blogger Simon Grey. In summary, the argument goes:

  1. Under most reasonable people’s understanding of property rights, a single owner of private property is entitled to keep anyone of his or her property for any reason whatsoever.

  1. A group of private property owners on adjacent properties may fence their properties together and do likewise.

  1. Such a group of property owners can further outsource the management of property linkages, such as common roads, sidewalks, etc. to a third-party (e.g. a homeowners’ association) if they so choose.

  1. The above is similar enough to a state that appeals to property rights are consistent with this analogy.

I find this argument unpersuasive, for following reasons: First, under this argument, natives also have a right to transact with immigrants, thus the concept provides no special reason to oppose immigration. Second, because this argument makes certain assumptions about governance of the commons, it ceases to be an argument about property rights and reduces to a declaration about moral governance (an argument which can be disputed on a purely moral basis independent of property rights). Finally, advocating for open borders is in no shape or form a violation of anyone’s property rights.

Some Problems With Collective Property

Property transactions involve property’s being either bought-and-sold or rented. Unless an immigrant intends to sleep on the streets, someone within the country has voluntarily elected to either sell or rent property to the newcomer. And while it’s always true that one might run away from his or her debts, the fact remains that any immigrant is always a party to some kind of business transaction in being here. Unless those business transactions occur exclusively among fellow-immigrants (a totally unreasonable assumption), immigrants are trading with domestic natives who wish to trade with them, too. Thus, this is exactly the opposite of “a roommate who doesn’t pay his rent.”

Almost paradoxically, the anarcho-capitalist counterfactual utilizes just this rationale in its argument against open borders. The argument is that, because every free market transaction is a de facto “restriction” on absolutely uninhibited use of another person’s property rights, the open borders concept is logically impossible. Clever logic like this is classic Hans-Hermann Hoppe, but it nonetheless misses the mark.

Giving things away for free is hardly what we have in mind when we argue for free markets. Similarly, opening borders to free human migration means allowing people to travel so that they can solicit the kind of free trade to which Hoppe refers. Knocking on doors, renting apartments, and answering wanted ads are not the kinds of activities we typically call property rights violations, and this is all we really have in mind when we talk about open borders. The anarcho-capitalist counterfactual is neither an argument against this kind of activity nor a particularly strong justification for the restriction of it.

Suppose I live in a private, gated community with Steve Sailer, Joe Arpaio, and Mike Huckabee. Further suppose that John Lee wishes to live in our community. If John wants to purchase or rent land from Sailer, Arpaio, Huckabee, or the homeowners’ association in which theirs is the majority opinion, they would be within their rights to decide that they don’t want John in their community, and refuse to sell or rent to him. But what if I choose to rent my property to John? Aren’t I within my own property rights to enter into a leasing agreement with John?

Opponents of immigration may counter that my participation in the homeowners’ association bars me from doing so. If true, what’s to stop me from ending my contract with the homeowners’ association and renting to John, anyway?

Only by asserting that the homeowners’ association’s collective control over my personal property – i.e. by asserting that collective property rights trump individual property rights – can we conclude that I cannot rent to John. Of course, opponents of immigration can always invoke the principle of collective property rights to argue against open borders, but such claims run contrary to the spirit in which property rights were invoked in the first place.

After all, I doubt that what conservative opponents of immigration have in mind is the supremacy of collective use of property over individual property rights. If they did, a significant shift in public opinion would invalidate their argument. Indeed, a significant shift in public opinion might even invalidate their individual claim to property.

Claiming The Commons

A second problem with the property rights argument against immigration is that it assumes that only immigration’s opponents own the commons. Embedded in an appeal to property rights to close the border is the assumption that the border itself and the state mechanisms deployed to enforce it work only for those who oppose immigration, and not for those of us who do not.

In truth, public land, public offices, and public resources are merely stewarded by the state. We call it “public property” only because it is not owned by private individuals. It is tempting for libertarian minds to reason that this is unfair or inappropriate – perhaps such reasoning even has a sound basis – but so long as property is owned and operated by the state, it is subject only to the will of the state.

Therefore, if the state decides to take an anti-immigration policy stance, the borders will be closed. If the state chooses to open the borders to the many benefits of free human migration, the borders will be open.

Vipul Naik previously summarized how the state might choose to govern its decisions here:

  • Radical agnosticism: The nation-state’s government can admit or deny non-citizens in a completely arbitrary fashion, without having to justify itself to either citizens or non-citizens. In this view, whatever the government decrees is the right thing.

  • Agnostic democratic fundamentalism: Non-citizens should be allowed or denied entry based on whether the majority of citizens would consent to their entry. […]

  • Citizenism via democratic fundamentalism: Here, elected representatives need to make decisions based on what the majority wants. But in addition, individual citizens, whether as voters or political lobbyists or elected representatives, need to make and justify their political decisions using citizenist premises.

  • Citizenism as a direct basis for political decision-making: Here, elected representatives directly make decisions on a citizenist basis, irrespective of what the democratic majority decrees. In the ideal world here, the ruler is a benevolent citizenist dictator.

Thus governance of the commons effectively reduces to a choice between the arbitrary decisions of our rulers, the democratic process, or Citizenism.

Nearly everyone agrees that the first choice is senseless by virtue of its being arbitrary.

Meanwhile, if proponents of the property rights argument object to democratic fundamentalism under the assumption that it violates their property rights, they must not subscribe to the principle of collective property rights discussed in the previous section. (Thus, my desire to trade with immigrants is an exercise of individual property rights equal to their desire that I not trade with immigrants.)

Finally, if proponents of the property rights argument wish to object on the grounds of Citizenism, then they are subtly shifting the discourse from one concerning the different types of house styles that people may choose to an entirely different argument altogether. In essence, they are suggesting that the varied property rights held by immigrants and the native citizens who choose to engage with them, perhaps in transactions involving homes of diverse architectural styles, can and should be overridden if such interactions do not pass the Citizenist moral test.

In light of the above, it seems that property rights arguments cannot appeal to the commons at all and truly remain property rights arguments.

Ethical Shortcomings

The previous two sections discuss problems with the validity of the property rights argument, but this argument isn’t just invalid; it’s also irrelevant. Why irrelevant? Because I need not deprive you of your property rights to make the case for open borders.

Consider Simon Grey’s position:

Let us also suppose that the man and his neighbors are all of the same ethnicity and thus decide to form a group that allows all members to utilize each other’s properties for travel (with reasonable but equal limits, of course) while simultaneously blocking everyone who is not a member of the group from crossing the properties at all.  Would all the members of this group be within their rights do so, even if we personally find this to be quite distasteful?  Again, the answer is yes.

Or, alternatively, as expressed by blogger “The Crimson Reach:”

People have bad reasons for how they wish to dispose of their property, of course. We can second-guess them and complain about them. But we too might have bad reasons for doing so…. In any event, simply having a bad reason for what you want to do with your property can’t, in and of itself, add up to an argument that you shouldn’t be allowed to do so. Not without, again, demolishing the concept of property.

We see that appeals to property rights are often made with full awareness of the fact that one’s motives for closing borders might not be good at all. They might even be terrible reasons for closing the border. This is likewise acknowledged in the academic literature. For example, philosopher Christopher Heath Wellman writes:

First, let me stress that I seek to defend a deontological conclusion about how legitimate states are entitled to act, not a consequential prescription for how to maximize happiness or a practical recipe for how states might best promote their own interests. I understand that groups can have weighty reasons to limit immigration in certain circumstances, but what the best policy would be for any given state’s constituents (and/or for those foreigners affected) will presumably depend upon a variety of empirical matters, matters about which others are more knowledgeable. Thus, I doubt that any one-size-fits-all immigration policy exists, and I, qua philosopher, have no special qualification to comment on the empirical information that would be relevant to fashioning the best policy for any given state. However, if anything, I am personally inclined toward more open borders…. My aim is merely to show that whatever deontological reasons there are to respect freedom of association count in favor of allowing political communities to set their own immigration policy.

All three people I have quoted argue the case that states, like individuals, are within their rights to determine to close the borders if they so choose.

But so what? Open borders advocates don’t want to deprive anyone of their property rights. It is full cognizance of and respect for property rights that moves us to make the case for open borders through persuasive reasoning. We certainly know that you are freely entitled to oppose immigration. But we think the benefits are clear, obvious, ethical, and rational; hence, we aim to make the case for opening the border to human migration – by choice.

Conclusion

In light of all of the above, I can only conclude the following:

  • Every economic transaction between an immigrant and a native reflects an implicit endorsement by the native of that immigrant’s status in the country, in full consideration of that native’s property rights. Thus, property rights are as much an argument for open borders as they are against open borders.

  • Ignoring this fact amounts to a presumption that either immigration restrictionists feel they own the commons, or feel they are more entitled to public property than the rest of us. But as we have seen, this position calls into question its validity as a position based on property rights.

  • Even if immigration restrictionists are within their rights to close the borders, that still does not address the fact that the arguments for opening the borders are an appeal to change minds, and are therefore no threat to anyone’s property rights whatsoever.

On all points, I find the property rights argument against immigration unpersuasive.
