Making the moral case for open borders: Crooked Timber’s symposium on the work of Joseph Carens

Bryan Caplan, the economist who originally inspired the founding of this website (and who is quoted in our masthead to this day), is a tireless advocate for both the economic and moral case for open borders. Today, however, he ought to take second billing to ethicist Joseph Carens, who has been building the moral case for open borders since the 1980s. The Crooked Timber blog is running a symposium on Carens’s new bookThe Ethics of Immigration. I highly encourage you to read the symposium contributions, which prod Carens’s case for its weak points.

In case you missed it when the book first came out (what, you mean you don’t pay attention to the latest and greatest developments in the ethics of border policy?), Dylan Matthews did a fantastic interview with Carens in the Washington Post which I cannot recommend highly enough. Carens summarises the thrust of his book, which he divides into two portions:

  1. First, he argues that even if you grant states utter carte blanche over who they can exclude via border policy, it follows from well-established principles of law and liberal democracy that states are still morally required to allow certain foreigners who may immigrate illegally to stay, once they have sufficiently integrated;
  2. Then, he argues that actually, you should not grant states carte blanche discretion in how they determine who to exclude, any more than you should allow a handful of feudal lords to determine the future of millions of serfs.

There’s obviously a lot more to it than that, so do read the interview (and Carens’s book, if you have the time). I’ve also previously written about that first portion of Carens’s argument on this blog. At the time I write this, Crooked Timber has so far published four takes on Carens’s ideas, by four different authors:

  1. Chris Bertram, criticising Carens’s assumption that his view of the “democratic consensus” about membership in liberal societies is widely-held
  2. Ryan Pevnick, arguing that Carens bites off more than he can chew when he posits that states should offer amnesty to unauthorised migrants who have sufficiently integrated into their societies (I’ve written about Carens’s argument here before)

Bertram’s promised in the inaugural post of the symposium that Carens will make an appearance at the end to respond to his critics. I’m looking forward to seeing what other responses they have lined up.

Ultimately, I believe the case for open borders rests much more than just on the pecuniary returns from liberating the families and workers of the world to go and be where they truly want to be. Even if the pecuniary returns to open borders were mildly negative, that would not constitute an open-and-shut case for junking the idea. On the contrary, I think the ethical case for scrutinising how our states exclude people on account of a condition of their birth is extremely resilient to different sets of economic tradeoffs.

That is not to say that I believe we ought to be insensitive or blind to the economic effects of immigration. I simply think that our societies need to weigh on our consciences as well how our immigration controls immiserate and exclude billions of people without any basis beyond the condition of their birth. Both the economic and moral case for open borders matter; I think philosopher Jason Brennan sums them both up nicely when he says:

If you have an economic system where everything can be globalised, except poor labour, then you make the world’s poor sitting ducks for exploitation. They can’t go where labour is scarce to get a good deal. They are forced to wait for capital to come find them and give them a bad deal. It’s not just that these restrictions are inefficient. Immigration restrictions impose poverty, suffering, pain, and death on some of the most vulnerable people in the world.

It should not surprise us that the economic disaster of closed borders might have ethical ramifications. Few government decisions, short of actually going to war, have the power to literally make or break the livelihoods and lives of hundreds of millions of people. In his book Let Their People Come, economist Lant Pritchett (another pioneer of the open borders movement) gives one illustration of the impact which border exclusions can have:

Amartya Sen has popularized the notion of “missing women” in Asia due to differential death rates and (increasingly) sex-selective abortion. Because the child mortality rate in India is about 100 per 1,000 while it is 8 per 1,000 in the United States, this implies that 92 per 1,000 more Indian children than U.S. children die before age five. This means there are 2.2 million missing Indian children each year.However, while the “missing women” is a standard refrain, I have never heard the term “missing Indians” to describe the results of the child mortality differentials between the rich world and India.

Now, to be sure, even under open borders we would likely not see full equality of child mortality rates across nations. But to the extent our border controls prohibit Indians from seeking access to more efficient healthcare delivery systems and more qualified doctors, we have contributed to the problem of “missing Indians” — innocent lives snuffed out on account of these babies “choosing” the wrong country to be born in. To bring it home, Pritchett actually goes on to cite Carens’s ethical analysis immediately after this discussion to reinforce his point.

(Pritchett’s book is a tour de force of the case for open borders, and as much as I like Carens, if you choose to read only one book after this, I don’t think you have much of an excuse for failing to read Pritchett: his book is available for free online. )

The nature of how our societies exclude billions of people carries huge ramifications, both economic and ethical. Even though we might disagree with the analysis here, it is critical that we understand just what these ramifications are. When our states literally hold the lives of people in their hands, as they often do when it comes to migration, we have an imperative to strictly scrutinise what our governments do in our name.

This is why Carens’s work matters: somebody has to ask hard ethical questions about government policies which, in arguably quite a literal sense, are a matter of life or death for hundreds of millions. I hope to see many more symposiums like this one. More than that, I hope to see these ideas penetrate the popular consciousness.

Some years ago, novelist Orson Scott Card authored a few brilliant, non-academic elucidations of ideas clearly embedded in Carens’s and Pritchett’s work. In fact, for an illustration of what Carens talks about when it comes to exclusion and arbitrariness, it is hard to outdo Card’s depiction of what would happen if the US were to deport all its unlawful immigrants. The ultimate point of the academy is to mine our brightest minds for the best ideas, and to have those ideas make a difference in our society: I hope to see more of Carens’s ideas (and also those of his reviewers in this symposium) seeping into the mainstream’s consciousness, just as they seem to have in the case of Card’s.

I started this post with a mention of economist Bryan Caplan, whose activism served as inspiration for this site. Perhaps it is fitting to close with Bryan’s words on just why this academic work is so important:

If research energy were proportional to the inefficiency of the status quo, virtually every economist would study immigration.  And if outrage were proportional to harm, virtually every protest on earth would be in favor of open borders.

How do open borders meaningfully differ from mainstream “immigration reform”?

Co-blogger Vipul raised recently the question of whether pursuing the radical concept of open borders is really worth it, compared to just focusing on moderate “immigration reform”. Given I blog here, my response to Vipul’s question is not in doubt. But there’s a basic question I think we can easily overlook if we try to answer Vipul’s question based on gut feel: how do open borders differ from moderate “immigration reform” which most pro-immigration liberals across the world work towards? Here, I’ll outline: several starting premises that we all share; three important ways in which we fundamentally disagree; and finally, one important thing which we actually agree on (or at least, don’t disagree anywhere close to the degree it’s commonly imagined).

At first glance, this seems trivial: open borders is a substantial or total dismantlement of existing border controls. Moderate liberal immigration reforms either seek to reinforce border controls while treating unlawfully-present immigrants better (e.g., most of the immigration reform proposals on the table in the US as of this writing) or minor loosening of border controls for certain types of people (e.g., proposals to allow for greater economic migration in certain job categories, or refrain from holding asylum-seekers in prisons). In other words, open borders supporters want to tear it all down, while moderate reformers simply want to selectively patch up or open certain parts.

This is not the whole story, however. You can’t explain the differences between open borders supporters and moderate reformers until you’ve looked at the reasons why their approaches diverge. Both groups of people I daresay come at the problem of immigration sharing certain perspectives and premises:

  • Economically, immigration is not harmful and actually can be a huge boon
  • Socially, immigration does not threaten the existing order and may actually strengthen and/or improve it
  • Most reasons commonly given for tight border controls have little basis in fact
  • The way border controls treat most prospective migrants is highly inhumane
  • The way governments treat irregular or unlawful migrants is also very inhumane

When you consider these points of agreement, it’s actually a wonder why these two groups of people advocating changes to our immigration systems land so far apart. Why do some embrace a completely radical view that concludes the whole edifice is rotten to its core, and must be fundamentally torn down and rebuilt, while others simply focus on what amount to tweaks — tweaks that no doubt affect the lives of millions, but remain almost infinitesimal compared to the changes which open borders might bring?

The first salient difference I can see is that open borders advocates are not afraid to follow the straightforward conclusions of immigration research to their ultimate conclusion:

  • Immigration is good for the economy? Awesome, why not allow as much immigration as people want to engage in? If a citizen wants to hire a foreigner, everyone benefits — so have at it!
  • Immigration doesn’t threaten our society? Great, yet another reason we can shut down government programmes that spend billions “defending” our borders from restaurant cooks and IT workers, and divert those precious resources to better uses for our nation.
  • Our immigration system treats millions of people as if they are subhuman? Seems like a good reason to begin shutting the whole thing down and replacing it with a more humane legal regime: we could just allow everyone who wants a visa to get one.

Already, I can hear the thousands of moderate reformers protest: that’s wholly unfeasible! That’s simply too crazy! But why is that? You can’t cite studies showing “Immigrants add $X to our economy” or “Immigrants pay $X million more in taxes than they get in benefits” or “Immigrants are less likely to commit crimes than people born here” without addressing the inescapable conclusion: if immigration is so good, what’s wrong with having more of it?

Now, to be sure, I’ve slightly oversimplified the social science here for the sake of argument. But none of the caveats to the conclusions I’ve cited above can at all come close to explaining the immense reluctance moderate reformers seem to have about reaching the inevitable conclusion of the research here. Using the very premises I outlined above that we agree on, it seems that open borders is the only defensible, reality-based policy.

You might protest that most of the evidence pointing to neutral or positive effects from immigration is based on existing levels of immigration. Open borders is sufficiently radical that it might just be “out of sample” for any of the empirical studies we have about migration’s effects so far. I would say that although not strictly empirical, we do have some pretty good evidence from the pre-closed borders era of the 20th century that open borders pose no existential threat to humanity or the nation; for an example, see my take on what open borders history suggests will happen to Latin-American migrants in the modern US. Either way, if we’re being truly honest about the social science, then the right skeptical position is: “We have every reason to believe open borders is the right thing to do. We must move towards it, monitoring the evidence as it comes in for proof to the contrary.”

Economist Bryan Caplan has made just this argument before, responding to the precautionary principle-based argument against open borders. Unfortunately, I’ve yet to meet a mainstream immigration reform advocate who openly takes such a position; the way most advocates talk, they’re happy to embrace empirical evidence which may support “immigration reform,” but shrink from any inexorable conclusion, no matter how firmly the evidence may point towards it, that open borders could possibly be the right thing to do. Most mainstream immigration liberals strike me as irrationally certain that the immigration status quo is backed by the evidence, and open borders aren’t — when actually just the opposite is true. But to give credit where credit is due, one of the few immigration liberals who has been willing to grapple with the tough question of open borders is Slate‘s Matt Yglesias, who had some pretty thoughtful things to say in response to criticism of open borders advocacy.

On to the second important area of disagreement: are loose border controls a government “subsidy” for migration, or are they simply relaxation of the state’s control on an organic human activity? In discussing migration with many of my liberal friends or acquaintances, I find many inherently frame an open migration policy as a subsidy to migrants, artificially spurring human activity that only occurs because the state has encouraged it. This paradigm is why someone like say, Vivek Wadhwa so casually dismisses open borders as not a very meaningful source of empowerment — because in his view, migrants don’t actually want to move! In this worldview, loose border controls are a subsidy to migration: people don’t actually want to move in some platonic world, but by opening the borders a little, you’ve subsidised their migration, and so they’ll pack up and leave the only home they’ve ever known.

I find this view very difficult to understand and almost as hard to rebut, because it seems so obviously self-refuting. Let’s say the government required you to apply for a permit before you were allowed to write any blog post. If government loosened the permit requirements, or abolished them altogether, would any sane person call this new blog permit policy a “subsidy” to bloggers?

It is of course true that loosening border controls promotes migration. But this promotion of migration occurs as a result of migration flows being able to edge back towards their natural state. Returning to my example, you would see an immense spike in blog posts if government abolished the application fees for blogging permits. This abolition of fees would be a “promotion” of blogging in one obvious sense of the word, but it clearly is not a subsidy to blogging — it is a removal of one government barrier to blogging.

In my opinion, seeing border controls as a government barrier, instead of just a natural state of the world, is one of the key differences between open borders advocates and mainstream reformers. If we treat borders as natural, and any loosening in their control as some sort of state “subsidy”, the right intuitive response would be skepticism. After all, a subsidy requires resources from the state. Even if no actual transfer payment is being made, government investment is required to effect the policy, and some prioritisation calls have to be made about the trade-offs of pursuing this particular subsidy or programme versus some other alternatives.

This is why, when open borders comes up, some mainstream liberal in the room will almost always pipe up: “But what about all the problems we have in our country? Sure, we could invest in open borders and that’d raise world GDP, halve world inequality, etc., but don’t we owe it to our citizens to spend our scarce resources on solving their problems first?” The stereotypical open borders response to this might be to stare flabbergasted at someone who just suggested it is more important to spend money on, say, domestic farm subsidies than on aiding the escape of people fleeing genocide. But honestly, we don’t even have to do that. You can be a good citizenist and nationalist and still find this cliched liberal response totally unappealing — because it’s coming from the unintuitive and senseless view that loosening border controls constitute a subsidy, instead of a removal of a barrier.

There is nothing natural about watertight controlled borders. Borders themselves are sometimes natural: rivers, mountain ranges, and so forth have marked out tracts of territory since time immemorial. Many borders are obviously artificial, drawn by some dead white man who might never have met anyone who lived on either side of the line he invented. Can we say that a system of brutal border enforcement truly serves the people’s interest, when these borders have often been drawn with utter disregard for the actual interests, welfare, or way of life of the people living on either side?

Whether drawn artificially or naturally, borders sealed to a degree where virtually nobody can cross are an immense historical aberration. There is nothing natural or logical about assuming a watertight border and taking any loosening of that to be an artificial subsidy. Quite the opposite: our society has to invest an immense amount of resources in sealing our borders to a degree that we fancifully imagine to be somehow “natural”.

The people suggesting that any loosening or opening of the borders would be a pull on the state’s or society’s limited resources are totally ignoring that tight border controls already pull immensely on our resources. Border guards do not work for free. Electrified fences do not build themselves. Prison camps for people fleeing war or economic disasters don’t spring out of nowhere. Plane tickets for deportees do not simply pay for themselves. Every dollar less that we can spend on deporting people or keeping them out is a dollar we can spend on a more deserving citizen here. There simply is no “investment” necessary to “subsidise” open borders.

This pernicious view of sealed borders as natural, and loose borders as a subsidy for migration, directly ties to the third fundamental disagreement: open borders advocates hold state-enforced border controls to a much higher bar for ethical legitimacy than moderate reformers do. Most moderate reformers are not very ethically- or morally-bothered by immigration laws.

A lot of the passionate moderate reformers I’ve encountered are bothered by these laws primarily to the degree that they affect people they know: in other words, migrants who are already present in the country. Open borders advocates on the other hand seem oddly-motivated and passionate about all the prospective migrants who aren’t even here yet, and, if we don’t open the borders, will never come. But this is because moderate reformers see sealed borders as a state of nature, and any loosening of the border as a subsidy to targeted classes of migrants. Consequently, they aren’t interested in open borders, which seem like an untargeted subsidy: it seems infinitely costly, and it’s not clear what the return on what seems like an infinite investment would actually be.  Moderate reformers want the “subsidy” of looser border controls to focus on groups they can immediately see as deserving target beneficiaries: children of illegal immigrants, some illegal immigrants, refugees, high-skilled workers. They don’t see much reason to care about other possible classes of migrants, since that’d be diverting the scarce resources necessary to enact the “subsidies” they’re seeking for these classes of migrants. It’s not morally- or ethically-important to consider people outside these narrow classes: sealed borders are the natural state of things, and it doesn’t make sense to invest resources in opening the borders to unskilled day labourers. The onus is on these “economic migrants” to prove why it’s worth investing in opening the borders to them.

Open borders advocates on the other hand find it ethically abhorrent to insist on removing barriers to organic human movement for certain classes of people, but not others. Why treat a refugee fleeing genocide so differently from another refugee fleeing famine, or another refugee fleeing economic collapse? What is the morally-relevant difference? If we allow refugees from one dictatorship open borders, but not refugees from other dictatorships, what morally-relevant reason is there?

The key difference is that moderates find arbitrary restriction of movement across borders totally ethically acceptable: of course it’s okay for the state to ban you from crossing if you don’t have a university degree, because we shouldn’t be investing scarce resources in subsidising migration for people like you. Open borders advocates reach a completely opposite conclusion: it’s completely ethically unacceptable for the state to do this arbitrarily. Allowing you to cross the border is not a subsidy to you; it is a loosening of an artificial government restriction. If you want to look for work here, come shop, go for a walk, whatever, the onus is on the state to show why your doing this would impose unacceptable costs that require you to be refused entry.

The different ethical bars that state controls over migration are held to here follow completely from the “subsidy versus felling a barrier” paradigm clash. And open borders advocates then go one step further to say: in most cases, there is no such unacceptable cost to society from allowing the person entry, and as such, there is no permissible reason for the state to refuse them entry. This follows entirely from the first disagreement: the evidence is overwhelming that in general, immigration is beneficial. To the extent the state refuses foreigners entry, it must narrowly target these refusals to the exceptions of the general rule that immigration benefits the economy and society.

This brings us to my last promised point: that in one respect, open borders advocates and moderates are not really that far apart. Except for no-borders advocates and anarchists, most of us sympathetic to open borders will grant the state the authority to regulate and control border crossings. I’ve drawn an analogy to trade in the past: nobody thinks “free trade” means that I should be able to import AK-47s at will. Governments control many aspects of movement and life. If you are carrying bird flu, as a general rule you should not expect freedom of movement, domestically or internationally. Open borders is not about allowing armed soldiers or criminal gangs to cross sovereign borders at their whim. Open borders is about allowing innocent people, who want nothing more than to seek a better life, to cross sovereign borders in peace. I don’t think we need to tear down all border checkpoints in the world to achieve open borders. It would be perfectly feasible to maintain border checkpoints in an open borders world: you’d simply approve every visa application unless evidence arises that the applicant has malicious intent, or otherwise is a person who poses a significant and meaningful threat to your society.

The vast majority of migrants in the world today, actual and prospective, neither have malicious intent, nor do they pose a threat to us. The social science shows that their coming here would benefit our economy. They wouldn’t undermine the foundations of our society. Preventing them from coming as if they are an invading army causes a disproportionate use of state force which violates basic human rights and common sense: in what way is it reasonable to bring warships to bear on refugees fleeing mass murder, or use gunships and drones to turn back people looking for a kitchen job that pays minimum wage? Unsealing our world’s borders would not be an untargeted, infinitely-costly subsidy to the migrants of the world, nor would it eliminate a fundamental natural feature of our states: it would simply free up billions of dollars for us to spend on our own citizens in more enriching ways, and allow millions of people to put their talents to better use serving us and each other. Open borders is a radical idea — and we should absolutely move towards it.

Worried about Hispanic immigration to the US? Your worst fears have already come true

More than any other country in the world, the US epitomises a country welcoming to immigrants. Its legacy of reaping the boons of immigration, and outsized influence on the world stage are why we so often discuss it on Open Borders, even if we firmly stand behind open borders across the world. In recent years, the US has been setting a bad example for the world on immigration, and we need to set the record straight. Americans today are happy to embrace their immigrant past, but reluctant to face their immigrant future. But these are two sides of the same coin — and the past tells us that American restrictionists’ worst fears have already come to pass — and gone.

Immigrants from Asia, Africa, and above all, Central and Latin America are taking centre stage in the US today. Hispanics especially represent the future of American immigration. As a result, any American can present you with a laundry list of concerns about Hispanic immigration:

  • They are low-skilled and poorly educated
  • They don’t learn our language
  • Their culture is rude, uncouth, and macho
  • They are migrating at an immense rate, far too quick for societal or political institutions to adapt
  • They bring their own language with them, and unabashedly force American institutions to accommodate their language
  • They are either apathetic or outright disloyal to the US, and pose a risk to national security

It is tempting for those on the left to dismiss concerns about immigration as rooted merely in the basest racism, bigotry, and prejudice. I would agree that anyone who has seriously examined the empirical data here will find these concerns to be overblown — even on the rare occasion that there’s a grain of truth to them, the situation is nowhere near as bad as restrictionists typically make it out to be. And it is true that immigration restrictions, especially in the US, have traditionally been founded primarily, if not entirely, on racial prejudice. But these are not reasons to casually dismiss reasonable people’s concerns about immigration today.

Now, for those who really think that, based on that laundry list I laid out above, Hispanic immigration is a major problem in the US and one that needs to be stopped at all costs, I simply say: your concerns, valid as they may be, were anticipated a long time ago. No less an American than founding father Benjamin Franklin expressed precisely the same sentiments about a new cohort of swarthy immigrants threatening to overwhelm the United States:

Those who come hither are generally of the most ignorant Stupid Sort of their own Nation… Not being used to Liberty, they know not how to make a modest use of it; and as Kolben says of the young Hottentots, that they are not esteemed men till they have shewn their manhood by beating their mothers, so these seem to think themselves not free, till they can feel their liberty in abusing and insulting their Teachers.

…now they come in droves, and carry all before them, except in one or two Counties; Few of their children in the Country learn English…They begin of late to make all their Bonds and other legal Writings in their own Language, which (though I think it ought not to be) are allowed good in our Courts…there is continual need of Interpreters; and I suppose in a few years they will be also necessary in the Assembly, to tell one half of our Legislators what the other half say; In short unless the stream of their importation could be turned from this to other colonies, as you very judiciously propose, they will soon so out number us, that all the advantages we have will not in My Opinion be able to preserve our language, and even our Government will become precarious.

Franklin went as far as to accuse these teeming masses of ignorant, uncouth immigrants of treason. When the colonies that would become the US fought the French, these immigrants refused to fight, and publicly argued that it would be better to surrender to the French instead:

…for when the English who were not Quakers, alarmed by the danger arising from the defenceless state of our Country entered unanimously into an Association within this Government and the lower Countries raised armed and Disciplined near 10,000 men, the Germans except a very few in proportion to their numbers refused to engage in it, giving out one among another, and even in print, that if they were quiet the French should they take the Country would not molest them; at the same time abusing the Philadelphians for fitting out Privateers against the Enemy; and representing the trouble hazard and Expence of defending the Province, as a greater inconvenience than any that might be expected from a change of Government.

Yes, the swarthy immigrants Franklin was talking about here were none other than the Germans. (While none of us would describe them as such today, he was quite explicit in his correspondence, describing peoples like the French, Russians, Swedes, and Germans as “swarthy” in complexion.) The early US faced a dramatic influx of a horde of immigrants, all from one particular country and cultural background. Even the most sympathetic immigration advocate would surely agree that at some point, “swamping” creates meaningful and dangerous risks to the established order and institutions of society.

But despite all the dangers he called out, Franklin saw no reason to demand mass deportations or even a closing of the borders. He simply wanted to encourage broader settlement of the new immigrants, greater funding for English-language schooling, and precautions against importation of criminals:

I am not for refusing entirely to admit them into our Colonies: all that seems to be necessary is, to distribute them more equally, mix them with the English, establish English Schools where they are now too thick settled, and take some care to prevent the practice lately fallen into by some of the Ship Owners, of sweeping the German Gaols to make up the number of their Passengers.

Maybe Franklin didn’t want to consider deportations or strict border controls because he didn’t believe in the feasibility of a massive militarised law enforcement apparatus that would be necessary to enforce these. We surely can feasibly have those things today (albeit at the cost of turning a leading democracy into a leading police state). But if we have learned anything from the German-American experience, why on earth would we want to?

In Ben Franklin’s day, Germans were swarthy, ignorant, unskilled, uncouth foreigners. They were alien to the people of the United States, and migrating in such vast numbers that they could have swamped and sunk the ship of state. But this clearly did not happen. Quite the contrary. Germans became truly American to a vast degree, despite continued immigration from Germany through the 19th century. If you keep ethnic descent in mind, then the Germans truly won World War II, as esteemed co-blogger Hansjoerg Walther has pointed out before:

Forget about General Eisenhower, and get used to Generalfeldmarschall Eisenhauer. Same for Chester Nimitz for the Navy (now: Generaladmiral Nimitz) and Carl Andrew Spaatz for the Air Force (now: Generalfeldmarschall Karl Andreas Spatz).

The Germans were as alien to the US Ben Franklin knew as Hispanics are alien to the US we know today. Actually, that’s wrong: the Germans were more alien. Hispanics have grown up in close proximity to the US, under the influence of its cultural and political leadership. They hail from democracies of some kind, and have a much better understanding of democracy than most any German growing up in the monarchic, aristocratic Germany of Ben Franklin’s day would have had. They have strong economic and cultural ties to the US. Many Hispanics are literally native Americans. Hispanics are far less likely to undermine the America we know today than the Germans were likely to undermine the America Ben Franklin knew in his day.

The Germans were truly alien to the US. But we no longer think of them that way. If I had told Ben Franklin that two centuries down the road, the largest single ethnic group in the country he helped found would be the Germans, he would have recoiled quite violently. But that is in fact the case: Germans are the largest single ethnic group in the modern United States, numbering almost 50 million. The Germans won World War II for the US. The Germans gave the US some of its greatest cultural contributions, including hot dogs and hamburgers. German-Americans include such American figures as Tom Cruise and Walt Disney.

Perhaps Ben Franklin would consider the modern US unimaginably impoverished by the supposed dilution of Anglo-Saxon culture and institutions. But the institutions that he established were preserved by generations of German immigrants. German-Americans gave their lives for these institutions in World War II. We don’t think of the hamburger as alien; it’s the quintessential piece of American cuisine.

If German immigration has taught us anything about swarthy, unskilled, uneducated, impolite, and politically apathetic immigrants, it’s that the United States will be just fine taking them in. The US admitted millions of Germans in an era of open borders when its institutions were unbelievably weak and newborn, and when those millions of Germans were coming in far greater numbers relative to the US population than anything we see today. The notion that US society and institutions are less equipped to cope with a similar influx under open borders conditions today than the US society and institutions of the Revolutionary Era is absolutely laughable.

We may be shocked to see what the America of 2063 or 2113 looks like. It may be even less familiar to us than the America of 2013 would be to Ben Franklin. But from all we’ve seen with German immigration, it seems quite clear that the waves of immigrants making the US their home today, Hispanic or otherwise, will turn out just fine.

And we can repeat this exercise ad infinitum. Other cohorts of immigrants have lessons to teach us too, after all. The Irish are the third-largest single ethnic group in the US today, numbering over 35 million, or over 10% of the population. And judging from the concerns of 19th century Americans facing a horde of Irish migrants, again, I think the US and its people will be just fine:

Why don’t Christians care more about open borders?

We’ve blogged a fair bit in the past about how Christianity demands open borders. It doesn’t get more simple than “There is neither Jew nor Gentile, neither slave nor free, nor is there male and female, for you are all one in Christ Jesus.” (Galatians 3:28) Co-blogger Nathan Smith has time and again (and again) taken to task restrictionists who co-opt the Bible in a hamhanded attempt to claim border restrictions and all the inhumanity they entail are ordained by God himself. Co-blogger Paul Crider has pointed out that if Christians take the Bible seriously, they need to speak out strongly against the evil of arbitrary border restrictions. Given all this, it seems to me that more than anything, the church today should be one of the strongest advocates for open borders. Yet, some of the Pope’s recent calls for greater humanitarian aid for migrants aside, migration seems to be hardly on the Christian agenda, if it is on there at all. Churches may pay migration lip service, but it seems like Christian institutions in general are far more concerned about homosexuality and contraception than they are about open borders. This is puzzling, when surely Christian doctrine must militate just as strongly for open borders as it does for almost any other social issue the church is focused on today.

I’ve read Nathan’s and Paul’s arguments before, and found them convincing, but I had forgotten about them until recently, when Evan blogged about Orson Scott Card’s views on immigration. Evan linked to a piece by Card reflecting on how Republicans in 2012 tarred and feathered Rick Perry for his defence of guaranteeing equal university subsidies to Texan residents regardless of immigration status. Evan didn’t focus on this, but one interesting part of Card’s piece was how vehemently he insisted that liberal immigration policies are clearly mandated by the Bible:

I think it’s worth pointing out, when we’re discussing how to treat the children of non-citizens in America, what the Lord said to the people of Israel as they were dividing the land near the temple site among the tribes:

“So shall ye divide this land unto you according to the tribes of Israel.

“And it shall come to pass, that ye shall divide it by lot for an inheritance unto you, and to the strangers that sojourn among you, which shall beget children among you: and they shall be unto you as born in the country among the children of Israel; they shall have inheritance with you among the tribes of Israel.

“And it shall come to pass, that in what tribe the stranger sojourneth, there shall ye give him his inheritance, saith the Lord God” (Ezekiel 47:21-23).

Now, this seems a clear principle to me, that God tells his people to share their inheritance with the children of strangers who dwell among them.

I’m quite aware that those of you who, as Perry said, have no heart, probably are already composing elaborate explanations of why God really means the opposite of the plain language of the scripture.

This prompted me to reread Nathan’s and Paul’s posts, especially the ones that explicitly rebut ostensibly Biblical restrictionist arguments. It amazed me just how spot on Card was when he pointed out that the Bible does not mince its words — and that you have to really twist the Bible to come up with any meaningful defence of the status quo, where we treat people who cross borders in search of a better life as if they are violent enemies of the state.

The other thing that came to my mind was how this might stack up against what the Bible has to say about other forms of inequality that our societies promote, either via social norms or by direct government action. The Bible says there is no Greek nor Jew, no slave nor free, no male nor female — yet for centuries, it was thought that the Bible is completely okay with enslaving people or treating women as inferior. Given how apathetic or antipathic most Christians seem to be about open borders, it seems fair to say even today, people think the Bible is completely fine with treating someone as an enemy before knowing anything about him other than his nationality — despite what Galatians says.

Galatians is not the last word, even if it sums up universal moral rights succinctly. Other Bible verses clearly come to bear on questions of equity and equality. A few months ago, I was browsing around the blog of Rachel Held Evans, a notable Christian blogger, and found her take on the Biblicalness (or lack of it) of slavery abolition:

…the fact of the matter is, the pro-slavery side had more going for it in the way of proof texts. Slavery apologists could cite passages like Genesis 17:2, Deuteronomy 20:10-11, 1 Corinthians 7:21, Ephesians 6:1-5, Colossians 3:18-25; 4:1, and I Timothy 6:1-2 to support their case. They pointed out that slavery was practiced by the people of Israel and regulated by God, and that Jesus never said a word against slaveholding. Even the apostle Paul instructs an escaped slave, Onesimus, to return to his master, they observed. Notably, many of the texts in question are the exact same texts—the Household Codes of Ephesians, Colossians, and 1 Peter—that are used today to support gender hierarchy in the home.

Many Bible-believing Christians, including those who were uncomfortable with slavery, just weren’t buying the abolitionist argument that placed the “spirit of the law” over the “letter of the law.” As Connecticut Congregationalist Leonard Bacon put it: “The evidence that there were both slaves and masters of slaves in churches founded and directed by the apostles, cannot be got rid of without resorting to methods of interpretation that will get rid of everything.”

I see Bacon’s dilemma, don’t you? Frankly, I’m glad I wasn’t trying to make a biblical case for abolition in the 19th century. I’m not sure I could have…or would have. Which is kind of sobering, right?

I have to agree: it’s incredibly sobering just how blatantly a by-the-letter-of-the-law reading of the Bible can lead one to blindly support the slavery or subordination of our fellow human beings. But what strikes me is how, in all the discussion I’ve seen of what the Bible has to say about immigration, we open borders advocates simply do not face the same conundrums that Christian abolitionists or Christian feminists once faced: the plain text of the Bible demands a large measure of equality irrespective of nationality.

Let’s go back to Card. His blustering condemnations of homosexuality make it surprising that he with such similar fervour demands open borders and liberal treatment of foreigners. But both of these make sense when you consider that all he is doing is applying the plain literal text of what he believes to be God’s word.

Now, as Christians, Card and I may disagree quite strongly about what God has to say about how we should treat our homosexual brothers and sisters. Here, I would have to follow the well-worn track of the Christian abolitionists and feminists who’ve come before us, and focus on the spirit of Christianity as revealed in the Bible, and summarised so well in Galatians: all human beings are created equal in dignity by God, and whatever you as a fellow human think of our sins or shortcomings, it is not your place to judge us, and it is not your place to punish or subordinate others for their sins or shortcomings. A system of justice is necessary, no doubt — but the Christian tradition is to render to Caesar what is Caesar’s, and render to God what is God’s. The judicial system should not enforce our personal judgments of others. However we might feel about blacks, women, gays, or foreigners, or what we might think the Bible says of them, it is not our place to force Caesar to enforce God’s judgment on others.

But I don’t need to take this tack with immigration restrictionists. All I need to do is to follow Card’s approach towards homosexuality, and quote the plain words of the Bible at those who want to oppress immigrants in the name of God. When God made the laws of Israel in Leviticus 19, he said: “Do not pervert justice; do not show partiality to the poor or favoritism to the great, but judge your neighbor fairly.” (Lv 19:15) He said: “When a foreigner resides among you in your land, do not mistreat them. The foreigner residing among you must be treated as your native-born. Love them as yourself, for you were foreigners in Egypt. I am the Lord your God.” (Lv 19:34-35) Now, to be fair, in this same chapter, God also makes the law: “Do not cut the hair at the sides of your head or clip off the edges of your beard.” (Lv 19:27) I’m guessing on this basis, you could well argue that the entirety of Leviticus should just be discarded. But the fact remains: if we are to blindly follow the letter of God’s instructions to us, we must abolish discrimination against foreigners in our governments’ policies.

You can certainly find verses in the Bible that might suggest some discrimination against foreigners is Biblical. But you cannot find any verses which contradict the basic principle, which is made clear in Leviticus, Ezekiel, and Galatians: do not mistreat immigrants, but love them as you love yourself. Treat their children the same way you would treat your children. All of us are human beings equal in fundamental rights and dignity. As Nathan’s said before,

In the debate among Christians about slavery in the 19th century, abolitionists tended to apply the loftier ethics taught in the New Testament, love thy neighbor and the Golden Rule and “inasmuch as ye have done it unto the least of these my brethren, ye have done it unto Me,” (Matthew 25:40), while apologists for slavery were more literalist, observing that Peter and Paul told slaves to obey their masters, and the patriarchs had slaves, and the Bible never seems to call for or envision a world without slavery. In the case of migration restrictions, too, the higher ethics of the New Testament clearly point towards open borders, but the difference is that the words of the Old Testament, too, quite literally and directly support welcoming the stranger in a fashion that there seems to be no sound warrant for interpreting otherwise than as a template for open borders.

Why then do Christians not heed the word of God and speak out against the grave injustices our governments and societies wreak upon innocent immigrants every day? Why do we not demand justice for the foreigner who wants to work in our country and contribute to our society? The restrictionist is quick to say that God has ordained international borders and we cannot contradict him — fair enough, but we don’t need to abolish borders, we just need to open them. The best defence I can see for the Christian restrictionist, ironically, is that Christians should not be trying to impose our values on the secular political system: render unto Caesar what is Caesar’s, and render unto God what is God’s.

This template for political disengagement might make sense, but I simply don’t see how most intellectually honest Christians can buy it. I think it’s fair to say most, or at least a lot of Christians want to do what is morally right by God. If we see harm being done, harm that goes against the moral principles laid down by our religion, it’s our obligation to do something about that harm. One thing we can do is, while avoiding confronting the actors behind these evils, help the victims of these harms. Churches can offer sanctuary and aid to immigrants who are being hunted by the state. And you can certainly make the argument that the church ought to do more. As Nathan’s observed before, Christians in democracies are sovereign citizens who have a say in making policy. There is nothing stopping Christians from vocally supporting and voting for leaders who would support an end to the global war on immigrants.

This is a different kettle of fish from using Christian morality as a basis to harm or oppress others. You can be a Christian who wants to use the power of the state to punish non-Christians, or to use the power of the state to punish people who sin by Christian standards. But you can also be a Christian who rejects Christian morality as a basis for harming or punishing others, while still embracing Christian morality as a basis for using the state to prevent people from coming to harm. I think there is a clear difference between these two types of Christians, and their respective kinds of political activism.

Immigration restrictions are a clear form of harm and oppression. They harm and oppress anywhere from “just” hundreds of millions to literally billions of people. And they do this in a very clear and unBiblical manner: by mistreating foreigners as if they are scum, rather than loving foreigners like we love ourselves. We do not need to demand that our governments provide equal measures of “social justice” or socioeconomic guarantees to all; Nathan himself has argued before that a modest amount of citizenism is still totally compatible with open borders and the fundamental principle of guaranteeing equal protection of the law to all, as Leviticus 19:15 instructs us. All we need to do is to demand the same basic rights for immigrants that we expect to be accorded ourselves: the right to live with, and take care of our own families. The right to work for an employer who offers us wages we are willing to accept.

The Bible does not waver on the point that we must love all humans as we love ourselves, irrespective of nationality. You might argue it’s infeasible to treat all humans as we treat our fellow citizens. But it’s impossible to treat all humans equally; that doesn’t mean we shouldn’t strive towards it. It’s easy to dismiss an idea as impractical without deep consideration. Unfortunately, I worry that this exact sort of dismissal is why Christians don’t give open borders the attention or consideration it so clearly demands. Rachel Held Evans concluded her discussion of abolitionism by noting a passage from the abolitionist tract Uncle Tom’s Cabin:

John Bird’s response to his wife’s perspective made me laugh out loud: “But, Mary, just listen to me. Your feelings are all quite right, dear, and interesting, and I love you for them; but, then, dear, we mustn’t suffer our feelings to run away without our judgment.”

I underlined that bit and wrote in the margins of my book, “sounds familiar!”

I worry that this is why the church does not take open borders more seriously. The governments of the world spend billions of dollars a year to point guns at unarmed civilians seeking a better life — civilians who the Bible has commanded us to love as if they are ourselves. If we take the Bible seriously at all, we have to heed both its letter and its spirit. If Christians are going to say they can’t follow through on what the Bible commands because it’s just far too impractical for us imperfect human beings to manage, they need to be sure they truly have a watertight case for that claim. As far as I can tell from the empirics, there is no such watertight case. Regardless of where one stands on social issues like homosexuality or contraception, it seems to me impossible to deny that the global war on migrants is a war on the family, a war on human life and human dignity. It is a mystery to me why the church as an institution and Christians as individuals appear so nonchalant and blasé about the evils of closed borders.

British hostility to immigration, and myths that refuse to die

The United Kingdom in the past few years has embarked on an aggressive campaign to cut down immigration. Restrictionist sentiments are alive and well amongst the British. A few months back, I wrote about how perplexing it was that even British left liberals, such as author David Goodhart, readily embrace restrictionist myths and assumptions. Unfortunately, in the UK — just as in most countries — the well-meaning side making the case on anecdotes instead of facts wins. Instead of debating the real issues at hand — such as what keyhole solutions are appropriate — we’re essentially debating whether Jews do in fact poison wells or Mexicans are in fact potheads.

Goodhart recently authored a book, The British Dream, purporting to show the disaster that has been British immigration. This book turned out to have played very loose and fast with the data, as economist Jonathan Portes observed in the London Review of Books. If you enjoy watching a train wreck, Portes published an unabridged version of his debate with Goodhart (since the LRB refused to give them both sufficient space to respond to each other) — Portes shows clearly how Goodhart has ignored the economics of immigration and blatantly insisted on substituting anecdotes for data.

This fact was driven home to me a couple months ago when I attended a Cato Institute panel on what economists think about immigration. The economic consensus: there is no evidence that immigration economically harms natives; any harms are so small that they are virtually indistinguishable from zero. Yet looking at the debate on immigration, you would think that only deportation can save the welfare state or provide jobs. Goodhart himself blames British immigrants for impoverishing British whites and stealing their jobs — and he is on the left of the British immigration debate!

After the Cato panel, one audience member from Ukraine came up to moderator Alex Nowrasteh and panelist Michael Clemens to say: your presentations were great, but what do your opponents say to rebut your claims that immigration doesn’t harm natives? Alex and Clemens essentially said: “nothing!” Even the strongest finding here has been that 20 years of immigration to the US caused a total 3% drop in the wages of low-skilled natives. If you take a simple average of that, it’s a 0.15% drop per year. And that itself is a figure which many economists mistrust, because it makes arguably naive assumptions about the economy — such as assuming capital investments don’t change in response to labour market changes. Why do even people on the left buy into the myths of immigration’s costs? This would be like a leftist saying “Yes, I suppose we can’t let all the Chinese in, since otherwise they might rape too many of our women, but we have to treat those we do let in better!”

The Cato panel focused on the US economy, but economists who’ve studied the issue in other developed countries have had just as hard a time finding harmful impacts to natives. Portes covers the issue well in his full discussion with Goodhart — British data show that youth unemployment fell in communities receiving more immigrants, which is exactly counter to Goodhart’s claims. Yet the myth that immigrants “steal” jobs persists.

The myth that immigration destroys jobs or drives down wages may seem a petty issue in comparison to the myth that Jews drink the blood of babies or that Mexicans are drug mules (this latter myth came up in plenty of informal discussion after the Cato panel, since one American Congressman had only just that week made the physically impossible assertion that virtually all unauthorised Mexican immigrants carried 75 pounds of marijuana with them across the border). But these economic myths are I daresay even more harmful than the petty racist myths that no right-thinking person today believes. These myths give a veneer of respectability to inhumane immigration policies that in fact destroy jobs, tear apart households, and spit upon the concepts of justice and fairness.

The Cato panel on what economists think about migration came to mind again and again as I followed a recent debate in the UK House of Lords about the impact of new immigration laws. The full transcript of that debate is quite interesting reading, and you can also always watch the debate if you prefer (the video opens at the start of the debate in the House of Lords that day, around 11am; skip ahead to 3:41pm for the start of the immigration debate).

The gist of the problem is this: the British government wants to reduce rates of immigration, by hook or by crook. To accomplish this, they have enacted seemingly arbitrary requirements for prospective immigrants to meet. And now, the government is reaping what it has sowed: British citizens are unhappy that their rights to invite and engage with foreigners have been severely curtailed, in the service of a regime that reduces jobs and families down to a single number: zero net non-EU migration. This debate in the House of Lords centred specifically on restrictions of the rights of British citizens and residents to invite their family members to the UK — rights that have been arbitrarily curtailed in worship of a nonsensical goal.

The debate is so interesting that I hope to blog about it in depth separately. Suffice it to say that it is a litany of failures in every imaginable way. When you have a government trying to centrally plan immigration — to issue an edict from upon high that no more than X number of immigrants must be allowed in — you have an economic and human disaster. Doctors who cannot care for their aged parents leave the country. British businesspeople who marry foreigners are told they should go live in Australia. A Syrian refugee trying to join her sons in the UK, with a charity guaranteeing and sponsoring her, is told by the British government that she should stay in the war zone that is Syria. The British government purports to establish a fair and firm regime for immigration — by mandating that only high-income Britons may marry a foreigner. It is estimated that almost half of all Britons do not earn enough to meet the income requirements for sponsoring a spouse’s visa — and even if they can apply, success is not assured, as in the case of one British-Australian couple told their visa was denied because there is no pressing need for their family to leave Australia.

In what must certainly be a frustrating turn of events for economists like Clemens and Portes, most of the Lords in that debate paid lip service to the goal of reducing immigration, taking for granted that it is, as matter of good policy, important and desirable to cut down immigration by what is essentially an arbitrary number pulled out of thin air. Some even forthrightly state that many of the new restrictions are good insofar as they create jobs for British youth. It is like hearing a lawmaker declare that it’s unfortunate that good people would be harmed by exiling all Jews, but at least this mass deportation would reduce the prevalence of poisoned wells in Britain.

Open borders — by which I mean an actual fair visa regime that grants a presumptive freedom of movement to all — is the only regime that can truly avoid the calamities and catastrophes we are witnessing today in the UK, and continue to witness every day across the world. As long as arbitrary laws ban our fellow humans from being with their families and seeking honest wages, we will continue to count the costs of closed borders in wasted tears, sweat, and blood. Any regime that declares “I have the arbitrary right to ban good people from being with their families if I feel like it” — which is exactly what the unjustified, pulled-out-of-thin-air numerical quotas of the sort we see in virtually every country today amount to — is utterly irreconcilable with basic humanity.

Open borders is not costless. One can well imagine that if we moved overnight from the closed borders regime to an open one, most developed countries would face an unmanageable flood of people. But it’s not clear to me why we count this as a cost of the open borders regime, rather than a cost of the closed one. If we had never closed the borders in the first place, we would never have had to worry about the adjustment costs of undoing our grievous mistake. Before we closed the world’s borders, we had no evidence that levels of immigration then reduced wages or employment. This is unsurprising; economists agree that the long-run effect of open borders is nil. It is only the short-run sudden release of migrants, held back artificially by arbitrary laws, that we need to manage carefully.

Only a few days ago, the Bristol Freedom Society hosted a debate on open borders — one that apparently went rather better for the open borders side than the similar Intelligence Squared debate recently hosted on the American side of the pond. Reflecting on the Bristol debate, Ben Southwood of the Adam Smith Institute cogently observed:

Any claim that migration should be kept to a particular level, because of the risk of undermining British institutions, implies an assumption about how much damage the marginal immigrant does or will do (reliably or with some probability). One cannot cop out of the question, you need to have an answer. But no one has yet set out good evidence about exactly how much damage to institutions the marginal immigrant does or will do—typically arguments in this area depend on anecdote or things that people feel they “just know”. This won’t do when the benefits to immigration are so high. We cannot simply assume the cost to our institutions outweighs the other benefits.

As Southwood suggests, the paucity of evidence for the claims frequently made about migration is appalling. Meanwhile, the evidence of the moral horrors of how we treat migrants is plain for all to see. Closing the borders for the sake of an arbitrary number ruins lives. We see that writ on a large scale today in the UK. There is no sense or logic possible under the law the moment justice is enslaved to an arbitrary quota. And it is all the more sad that the profound injustice of a quota on jobs and a quota on families is being perpetuated on the basis of ignorance and falsehoods. In no other area of law or public policy do we let the government so wantonly rip up families and destroy jobs, without due process, relying only on the evidence of myths — to the extent they rely on evidence at all. It’s time we demanded our governments do something different about immigration — something actually informed by the evidence and consistent with the rule of law.
